FIRST AMENDMENT TO
CITY SECRETARY CONTRACT NO.48139
A LEASE AGREEMENT BETWEEN
WEST MOUNT MORIAH MISSIONARY BAPTIST CHURCH
AND
THE CITY OF FORT WORTH
This AMENDMENT NO. 1 ("Amendment") is made and entered into by and between WEST
MOUNT MORIAH MISSIONARY BAPTIST CHURCH("Lessor")by and through W.L.D. Campbell,
its duly authorized Pastor, and the CITY OF FORT WORTH("City"), a home rule municipal corporation
organized under the laws of the State of Texas, acting by and through Dana Burghdoff, its duly authorized
Assistant City Manager.
WHEREAS,the Lessor and City entered into City Secretary Contract No.48139,a lease agreement
for space located at 5335 Bennett Avenue, Fort Worth, Texas 76107 ("Leased Premises"), effective
September 1,2016("Lease"), as more particularly described in the Lease; and
WHEREAS,Lessor and City desire to amend the Lease to add three (3) additional, automatic, and
successive, one (1) year renewals (Additional Renewals) and also to increase the rent amounts for the
Additional Renewals by one hundred dollars per month.
NOW THEREFORE, in consideration of the covenants and agreements set forth in the Lease,
Lessee and Lessor agree to amend the Lease as follows:

Subsection (b)of Section 3 "Term"of the Lease is hereby amended by adding three(3)
Additional Renewals as defined above in this Amendment with each of the Additional Renewal terms
commencing October 1, 2021, October 1, 2022, and October 1,2023,respectively.

Section 4 of the Lease"Rent"is hereby amended by adding an additional sub-section"(f)"which
will state as follows:
(f) Rent for the Additional Renewals shall be Seven Thousand and Two Hundred
Dollars $7,200.00)annually per Additional Renewal term,or Six Hundred Dollars
600.00 per month and this rental rate shall remain in effect in the event of any
extension or holdover of this Lease beyond the expiration of the Additional
Renewals,unless otherwise agreed in writing by the parties."

All other terms and conditions of the Lease remain unchanged and in full force and effect.

Worth, Texas 76107 Used as a Police Storefront by the Fort Worth Police Department
RECOMMENDATION:
It is recommended that the City Council authorize execution of an amendment to City Secretary
Contract 48139, A lease agreement with West Mount Moriah Missionary Baptist Church, to add three
(3) additional one-year renewal terms for space located at 5335 Bonnell Avenue, Fort Worth, Texas
76107 used as a police storefront by the Fort Worth Police Department.
DISCUSSION:
On March 3, 2009, in Mayor and Council Communication (M&C) C23373, the City Council approved
the execution of a lease with West Mount Moriah Missionary Baptist Church for space located at 5335
Bonnell Avenue, Fort Worth, Texas 76107 to be used by the Fort Worth Police Department as a
police storefront. The lease was effective March 26, 2009 and expired on November 30, 2015,
but continued on a month-to-month basis until September 30, 2016 with rent of$4,800.00 per year
(City Secretary Contract No. 38363).
On August 23, 2016, City Council approved the execution of a new lease with West Mount Moriah
Missionary Baptist Church for continued use of the space (M&C L-15941). The lease was effective
October 1, 2016 and allowed for four (4) one-year renewal terms, the last of which will expire on
September 30, 2021 for a total cost of$33,300.00 (City Secretary Contract No. 48139).
The City and West Mount Moriah Missionary Baptist Church have agreed to amend the lease to add
three (3) additional one-year renewal terms, the first additional renewal beginning October 1,
2021 and the last to potentially expire September 30, 2024 at a cost of$600.00 per month, for a
potential total cost of$21,600.00 for the duration of the lease renewal terms.
Each renewal term shall be contingent upon approval of Crime Control and Prevention District
(CCPD) funds.
This property is located in COUNCIL DISTRICT 3.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that upon approval of the above recommendation and adoption of
the Fiscal Year 2022 Budget by the City Council, funds will be available in the Fiscal Year 2022
operating budget, as appropriated, in the Crime Control & Prev Distr Fund. Prior to an expenditure
being incurred, the Police Department has the responsibility to validate the availability of funds.
