STRICI~LAND AS MUNICIPAL, JUDGES FOR TLIE UNEXPIRED PORTION OF TWO-YEAR TERMS COMMENCING JUNE 1, 2006 AND ENDING MARCH 31., 2008 OR UNTIL A SUCCESSOR IS QUALIFIED AND APPOINTED IN ACCORDANCE WITH STATE LAW; THAT THE TERMS OF THE TWO MUNICIPAL JUDGES NOT BEING REAPPOINTED EXPIRE ON MAY 3l, 2006; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT ~10RTH, TEXAS SECTION l . That Andrew Bradshaw and Nancy E. Strickland he appointed as Municipal Judges for the unexpired portion of two year terms commencing June 1, 2006 and ending March 31, 2008, or until a successor is qualif ed and appointed in accordance with state law. SECTION 2. That the terms of the two Municipal Judges who are not being reappointed expire as of May 31, 2006. SECTION 3. This ordinance sha11 be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where provisions of this ordinance are in direct conflict with the provisions of such ordinances and Code, in which event such conflicting provisions of such ordinances and Code are hereby repealed. SECTION 4. It is hereby declared. to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared void, ineffective or uncons#itutional 6y the valid judgment or final decree of a court of competent jurisdiction, such ineffectiveness or uncoaastitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation herein of any such void, ineffective or unconstitutional phrase, clause, sentence, paragraph or section. Strickland as Municipal Judges for the Unexpired Portion of Two-Year Terms Commencing on June 1, 2006 RECOMMENDATIC)N: I# is recommended that the City Council adopt the attached ordinance appointing Andrew Bradshaw and Nancy E. Strickland as Municipal Judges for the unexpired portion of two-year terms commencing on June 1, 2006 and expiring on March 31, 2(708, or until a successor is qualified and appointed in accordance with state law. DISCUSSION: Chapter 30 Section 30.00006(b} of the Government Code under the Uniform Municipal Court Act requires the governing body of a municipality to appoint its municipal judges by ordinance. Adoption of the attached ordinance would appoint Andrew Bradshaw and Nancy E. Strickland as Municipal Judge pursuant to Section 30.00006{b} of the Government Code. On April 27, 2006, the Ad Hoc Municipal Court Advisory Committee voted to recommend to the City Council the above listed persons for appointment as Municipal Judges. The Committee recommends that the terms of the Municipal Judges who are currently in holdover status be continued through May 31, 2006, but that those individuals nat be reappointed to a new terms of office.
