HomeMy WebLinkAboutOrdinance 20513-12-2012Ordinance No. 20513-12-2012 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE PARK GAS LEASE PROJECT FUND INTHE AMOUNT OF $100,000.00, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF TRANSFERRING SAID FUNDS TO THE COMMUNITY TREE PLANTING PROGRAM FUND TO FUND THE COMMUNITY TREE PLANTING PROGRAM; PROVIDING FOR A SEVERABIL17FY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OFTHE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2012-2013 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations m the Park Gas Lease Projects Fund in the amount of $ 100,000.00, from available funds, for the purpose of transferring said funds to the Community Tree Planting Program Fund to fund the Community Tree Planting Program. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, wh=ich said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No. 2041 1 -09 -20 12 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the use of $118,219.00 of Tree Removal Fee Revenue and a donation in the amount of $100,000.00 from Chesapeake Energy Corporation to fund the Community Tree Planting Program; 2. Authorize the use of $100,000.00 of Parks Royalty Revenue to fund the Community Tree Planting Program; 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Park Gas Lease Project Fund in the amount of $100,000.00 from available funds; 4. Authorize the transfer in the amount of $100,000.00 from the Park Gas Lease Project fund to the Community Tree Planting Program fund; and 5. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Community Tree Planting Program fund in the amount of $318,219.00 from available funds. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to authorize the use of funds from various sources to fund the Parks and Community Services Department's Community Tree Planting Program (the Program). During the Fiscal Year 2009 budget deliberations, the City Council directed and subsequently authorized the use of three funding sources in order to continue the Program, which was slated for elimination. These sources include Tree Removal Fee Revenue, Parks Royalty Revenue and donations from Chesapeake Energy Corporation. On September 16, 2008, (M&C G-16276) the City Council authorized the acceptance of a monetary donation in the amount of $100,000.00 per year for five years for a total of $500,000.00 from Chesapeake Energy Corporation. This will be the fifth and final year for the donation from Chesapeake Energy Corporation. This action reduced the burden on the City's water supply and resulted in a one-time savings in the amount of $57,559.42 to the Program. Funding for this program provides for six authorized positions consisting of two Foresters and a four- person nursery production/tree planting crew and related supplies, materials and services. The Program provides approximately 1,600 trees annually for neighborhood associations and organizations for community tree planting projects on public property. Additionally, the Foresters included in this Program manage the Citizen Forester Program and other volunteer programs which train volunteers for tree planting, data collection and ongoing care and maintenance of the City's tree farm. The Community Tree Planting Program benefits ALL COUNCIL DISTRICTS. FISCAL INFORMATION / CERTIFICATION: The Financial Management Services Director certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the current operating budget, as appropriated, of the Community Tree Planting Program Fund.
