HomeMy WebLinkAboutOrdinance 20514-12-2012Ordinance No. 20514-12-2012 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE COMMUNITY TREE PLANTING PROGRAM FUND IN THE AMOUNT OF $318,219.00, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING THE COMMUNITY TREE PLANTING PROGRAM; PROVIDING FOR A SEVERABfLITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2012-2013 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Community Tree Planting Program Fund in the amount of $318,219.00, from available funds, for the purpose of funding the Community Tree Planting Program. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 20411-09-2012 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect upon adoption. The purpose 0f this Mayor and Council Communication (K4@C)iShO authorize the use Of funds from various sources tofund the Parks and Community Services Department's Community Tree Planting Program (the Pn3g[8[O\.During the Fiscal Year 2OOQ budget deliberations, the City Council directed and subsequently authorized the use of three funding sources in order to continue the Program, which was slated for elimination. These sources include Tree Removal Fee Revenue, Parks Royalty Revenue and donations from Chesapeake Energy Corporation. On September 18,20O8'/W1&C G-10270\ the City Council authorized the acceptance 0famonetary donation iO the amount [f $1DO.00O.00 per year for five years for @ total [f $5DD.0DD.00 from Chesapeake Energy Corporation. This will bethe fifth and final year for the donation from Chesapeake Energy Corporation. This action reduced the burden on the City's water supply and resulted in a one-time savings in the amount of $57,559.42 to the Program. Funding for this program provides for six authorized positions consisting 0f two Foresters and a four- person nunseryproUuCUon/treep|@UtiOQCrevvaDdne|atedsupp|i8S.nn8tSri8|S8ndserVices.ThePrOg:]O0 provides approximately 1,0OOtrees annually for neighborhood associations and organizations for community tree planting projects on public property. Additionally, the Foresters included iD this Program manage the Citizen FOr8St8[ P[0g[8nO and other volunteer programs which train vu|UDiee[s for tree planting, data collection and ongoing care and maintenance Of the City's tree farm.
