HomeMy WebLinkAboutOrdinance 20519-12-2012Ordinance No. 20519-12-2012 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIALLY FUNDED CAPITAL PROJECTS FUND IN THE AMOUNT OF $2,100,000.00, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF STREETSCAPE IMPROVEMENTS, WHICH CONSIST PRIMARILY OF LANDSCAPE ENHANCEMENTS ALONG WEST ROSEDALE STREET BETWEEN EIGHTH AVENUE AND LIPSCOMB STREET AND JENNINGS AVENUE TO SOUTH MAIN STREET; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2012-2013 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Specially Funded Capital Projects Fund in the amount of $2,100,000.00, from available funds, for the purpose of streetscape improvements, which consist primarily of landscape enhancements along West Rosedale Street between Eight Avenue and Lipscomb Street and Jennings Avenue to South Main Street. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 20411-09-2012 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Rescind Mayor and Council Communication C-25040 and repeal associated Resolution No. 4014 -08- 2011 and Ordinance No. 19822-08-2011 all of which authorized the execution of and provided funding for a funding Agreement with the Texas Department of Transportation in the amount of $4,692,090.00 with City participation in the amount of $2,572,090.00 for the West Rosedale Project between Eighth Avenue and South Main Street; 2. Authorize the acceptance of a contribution in the amount of $2,100,000.00 from the Special Assessment District Fund, TIF District No. 4, to the Specially Funded Capitial Projects Fund; 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Specially Funded Capital Projects Fund in the amount of $2,100,000.00 from available funds; and 4. Authorize the execution of a contract with The Fain Group, Inc., in the amount of $3,244,347.85 for streetscape improvements, which consist primarily of landscape enhancements along West Rosedale Street between Eighth Avenue to Lipscomb Street and Jennings Avenue to South Main Street. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to (1) rescind M&C C-25040 approved by Council on August 2, 2011 and repeal the associated resolution and ordinance which authorized a funding Agreement with Texas Department of Transportation (TxDOT), but which was never executed and subsequently, there was no grant project created in the Grant Capital Projects Fund, (2) authorize acceptance of contribution from the TIF District No. 4 (Southside TIF) in the amount of $2,100,000.00, (3) adopt an appropriation ordinance to transfer those funds to the Specially Funded Capital Projects Fund and (4) authorize the execution of a construction contract with The Fain Group, Inc., in the amount of $3,244,347.85 for streetscape improvements, which consist primarily of landscape enhancements along West Rosedale Street between Eighth Avenue and Lipscomb Street and Jennings Avenue to South Main Street. The West Rosedale Streetscape Improvements project is a streetscape improvement project that will Logname: 20WEST ROSEDALE STREETSCAPE IMPROVEME114TS PHASE 2 Page I of 3 significantly alter the appearance of the roadway by providing landscape and pedestrian enhancements from Eighth Avenue to South Main Street. This phase of the project includes reduction in the number of vehicle lanes from six to four and includes the addition of curb line bulb-outs, on-street parking, pedestrian improvements, landscaping and lighting under a context sensitive approach to enhancing the corridor. The construction of the West Rosedale Streetscape Improvements project is divided into two phases. Phase 1, from Lipscomb Street to South Jennings Avenue, was approved for construction by M&C C- 25731 on July 17, 2012. West Rosedale Streetscape Improvements Phase 2 limits are from Eighth Avenue to Lipscomb Street and Jennings Avenue to South Main Street. On July 17, 2012, (M&C C-25746) the City Council adopted Resolution No. 20294-07-2012 authorizing a Local Project Funding Agreement with TxDOT for the West Rosedale Streetscape Retrofit Project, accepting grant funds in the amount of $2,000,000.00 from TxDOT Regional Toll Revenue (RTR) Grant Funds, authorizing a transfer in the amount of $500,000.00 from the Street Improvement Capital Project Fund to the Grant Fund for the City's local match and adopting Ordinance No. 202294-07-2012 increasing the estimated receipts and appropriations in the Grant Fund in the amount of $2,500,000.00. Total project funding in the amount of $4,600,000.00 includes the $2,500,000.00 described above and the Fort Worth South (TIF District 4) contribution of $2,100,000.00. The construction contract with the Fain Group, Inc., is funded by $2,1100,000.00 from TIF District 4 and $1,144,347.85 from TxDOT RTR Grant Funds. This project was advertised for bid in the Fort Worth Star - Telegram on March 8, 2012 and March 15, 2012. The Fain Group, Inc., is in compliance with the City's M/WBE Ordinance by committing to 23 percent M/WBE participation. The City's goal on this project is 23 percent, This project is located in COUNCIL DISTRICT 9, Mapsco 76M and 77J.
