HomeMy WebLinkAbout(0095) M&C 21-0677City of Fort Worth, Texas Mayor and Council Communication DATE: 09/14/21 M&C FILE NUMBER: M&C 21-0677 LOG NAME: 21T-MOBILE COMMUNICATIONS TOWER LICENSE 2NDAMENDMENT SUBJECT (CD 6) Authorize Execution of a Second Amendment to City Secretary Contract Number 47335, a Communications Tower License Agreement with T-Mobile West LLC, Which Will Allow the Lease of Additional Space on the City of Fort Worth's Columbus Trail Radio Tower for Access to the City's Electricity Generator for Purposes of Maintaining Backup Electrical Services RECOMMENDATION: It is recommended that the City Council authorize the execution of an second amendment to City Secretary Contract Number 47335, a Communications Tower License Agreement with T-Mobile West LLC, which will allow for the lease of additional space on the City of Fort Worth's Columbus Trail Radio Tower to allow access to the City's electricity generator for purposes of maintaining backup electrical services. DISCUSSION: Since 1999, the City of Fort Worth (City) has leased space on its radio tower, located at 4100 Columbus Trail (leased premises), to allow for the operation of certain communications equipment. In 2015, the City negotiated a Communications Tower License Agreement with T-Mobile West LLC (T-Mobile) under City Secretary Contract Number 47335 for a term of 15 years, including renewal terms. In 2018, the City and T-Mobile executed an amendment to City Secretary Contract Number 47335 which allowed T-Mobile to install additional antenna equipment on the leased premises (First Amendment). Now, T-Mobile has requested additional use of the leased premises to allow for backup electrical services through access to the City's electricity generator. Granting this request provides for an additional annual license fee of $300.00. T-Mobile shall also pay to the City a one-time fee in the amount of $2,820.00 as additional consideration for this access. There are no costs to the City associated with this initiative. All site improvements and enhancements are at the sole expense of T-Mobile. The Columbus Trail Radio Tower is located in COUNCIL DISTRICT 6. A Form 1295 is not required because: This contract will be with a publicly -traded business entity or a wholly -owned subsidiary of a publicly -traded business entity: T-Mobile US, Inc. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendation and execution of the second amendment to the contract funds will be deposited into the General Fund.
