HomeMy WebLinkAboutOrdinance 20523-12-2012Ordinance No. 20523-12-2012 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GENERAL FUND IN THE AMOUNT OF $40,000.00, UPON "RECEIPT OF PAYMENT FROM LlNEBARGER GOGGAN BLAIR AND SAMPSON, LLP, FOR THE PURPOSE OF REFLECTING A PAYMENT FOR COLLECTION OF DELINQUENT PARKING AND CRIMINAL CITATIONS; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2012-2013 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the General Fund in the amount of $40,000,00, upon receipt of payments from Linebarger Goggan Blair and Sampson, LLP, for the purpose of reflecting a payment for collection of delinquent parking and criminal citations. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 20411-09-2012 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. On July 1O'2O12'(K8&C C-25713) the City Council authorized the City Manager hJ negotiate and execute a contract with law firm of Linebarger Goggan Blair & Sampson, LLP (Linebarger), for the collection of delinquent civil parking and criminal citations. AG part Ofthe negotiations, Lineb@rQ8r agreed tO provide h} the City 2n annual payment iOthe amount Of$15.00O.O0 for supplemental law enforcement services during warrant round-ups or special initiatives as designated by the Municipal Court Services Department. Additionally, 2 payment iDthe amount Of$25'OOO.00 was negotiated for use in promotional and special enforcement efforts associated with collection of debts and accounts receivable. Under City Secretary Contract NO.4345O. this payment ia made from the firm's separate funds and not from any monies that Linebangerneoeivma as compensation under the Agreement. In addiUon, this payment is due and payable regardless of whether Linebarger's collection efforts result in any recovery of the accounts receivable or of Linebarger's fee.
