AN ORDINANCE AMENDING ARTICLE II, AVIATION
BOARD AND DEPARTMENT, OF CHAPTER 4 OF THE CODE
OF THE CITY OF FORT WORTH (1964), AS AMENDED;
PROVIDING FOR THE ESTABLISHMENT OF AN AVIATION
BOARD; PROVIDING FOR INTERNAL ORGANIZATION,
POWERS, JURISDICTION AND SCOPE OF ACTIVITY;
AUTHORIZING THE APPOINTMENT OF AN AIRPORT
MANAGER AND EMPLOYEES BY THE CITY MANAGER;
PROVIDING FOR AN ANNUAL AUDIT; DECLARING A
GOVERNMENTAL FUNCTION; PROVIDING FOR ACCOUNT-
ING PROCEDURE; PROHIBITING ANY FINANCIAL IN-
TEREST BY MEMBERS OF THE AVIATION BOARD IN THE
SALE OF ANY LAND, MATERIALS, SUPPLIES OR SERV-
ICES; PROVIDING FOR ASSISTANCE FROM OTHER CITY
DEPARTMENTS AND RESOLUTION OF CONFLICTS WITH
OTHER DEPARTMENTS; AND NAMING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS:
SECTION 1.
That Article II, Aviation Board and Department, is
hereby amended so that hereafter same shall read and be as
follows:
Sec. 4 -6. Aviation Board -- Created; composi-
tion; appointment; eligibility for
appointment; compensation.
There is hereby Oouncil. blished an Aviation
Board consisting of Clem ers to be ap-
pointed by the City No person shall
be eligible for appointment to membership on
the Board who is not a citizen of the United
States and a resident of the City of Fort
Worth. The members of the Board shall serve
without compensation.
Sec. 4 -7. Same -- Term.
The term of office of members of the Avia-
tion Board, subject to the provisions relative
to removal therefrom, shall be two years. No
member may be appointed to serve more than
three two -year terms.
Sec. 4 -8. Same -- Removal; public hearing on
removal; filling vacancies.
Members of the Aviation Board shall be
subject to removal from office by the City
Council. Any vacancy in the membership
of the Board shall be filled by the City Coun-
cil for the unexpired term of the member whose
place has, by removal or otherwise, become
vacant.
Sec. 4 -9. Same -- Internal organization; Secre-
tary and meetings.
Every two years the Aviation Board shall
elect one of its members as Chairman and one as
Vice - Chairman, and the Board shall appoint a
Secretary, who may, but need not be, a member
of the Board. If a member of the Board is not
appointed as Secretary, then an employee of the
City may be appointed Secretary. The Aviation
Board shall hold regular monthly meetings and
such special meetings as may be necessary.
Sec. 4 -10. Same -- powers; jurisdiction; scope
of activities.
The Aviation Board, subject to the authority
of the City Council, shall have the responsi-
bility to recommend to the City the planning of
any extensions, improvements and additions to the
airports system and its master plan. Such Board
may also recommend the adoption of rules and regu-
lations for the government of the airports sys-
tem. The Board will review and comment on the
annual operating budget and capital improvement
requests. The Aviation Board may make recommenda-
tions to the City Council consistent with the
Charter concerning the leasing of lands and /or
the granting of concessions or franchises for
the privilege of doing business in or on the
properties of the airports system in cases where
such leases, concessions or franchises might have
an impact on the development of the airports sys-
tem and its master plan. The Board may review
and recommend to the City Manager and the City
Council a schedule of rental rates and other
fees and charges for tenants and other lessees of
airport property.
Sec. 4 -11. Aviation Department -- Established;
administration.
There is hereby established an Aviation De-
partment, and the same shall be administered
as hereinafter provided.

Sec. 4 -12. Same -- Appointment of employees
by City Manager; employees sub-
ject to City Personnel Rules;
bonds.
The City Manager shall appoint an Airport
Manager, subject to the approval and determina-
tion of salary therefor by the City Council.
The City Manager shall also appoint and employ
such other officers, assistants and personnel
as he may deem necessary for the efficient ad-
ministration of the affairs of the Aviation
Department and prescribe and fix their duties,
scope of authority and qualifications. All
officers and employees of the Aviation Depart-
ment shall be employees of the City, and, as
such, shall be governed by the Personnel Rules
of the City and the classification and compensa-
tion plan for City employees.
Sec. 4 -13. Same -- Sources of Funds for opera-
tions.
The Aviation Department shall be allowed
all receipts and revenues from the operation of
the airports system of the City and the proceeds
from any ad valorem tax levied specifically for
aviation purposes by the City Council, if and
when such tax is levied and collected, together
with whatever further amount, if any, the City
Council may, in its discretion, set apart in the
annual budget for the use of such department.
From such sources shall come the appropriation
to be annually set apart in the budget for the
airports fund for the operation, maintenance and
upkeep of the airports system. The funds allo-
cated to the Aviation Department shall be deposited
with the City Treasurer to the credit of the air-
ports fund, subject to disbursement in accordance
with the budget approved by the City Council,
for the purposes and in accordance with the pro-
visions of this Article, the same to be paid out
only upon warrants approved by the Airport Man-
ager, issued by the Commissioner of Accounts,
signed by the City Treasurer, and countersigned
by the Commissioner of Accounts.
Sec. 4 -14. Same -- Annual audit.
At the end of each fiscal year, the Department
of Finance shall have made a full and complete
audit of the accounts and business of the Avia-
tion Department for the year then ending, at
least one certified copy of which shall be filed
with the City Council and at least one other cer-
tified copy with the Aviation Board.

Sec. 4 -15. Same -- Declared governmental func-
tion; disclaimer of personal liability.
All of the regulations and acts of the Avia-
tion Department performed and to be performed
in accordance with the provisions hereof in the
operation and maintenance of the airports sys-
tem of the City are hereby declared to be gov-
ernmental and for the benefit of the general
public. Any member of the City Council, the
Aviation Board, and any City official or employee
charged with the enforcement of the provisions
of this Article, acting for the City in the dis-
charge of his duties hereunder, shall not thereby
render himself personally liable.
Sec. 4 -16. Accounting procedure for Aviation
Board and Aviation Department.
The Commissioner of Accounts shall prescribe
and provide for the use of the Aviation Depart-
ment all forms for the keeping of its accounts
and vouchers necessary to be used in the conduct
of its business, which forms and methods of ac-
counting shall be employed by the department in
conducting its business so as to conform as nearly
as possible to the method of accounting instituted
and enforced in the Department of Finance. The
Aviation Department shall conform to such rules
and regulations regarding financial affairs as
are promulgated by the Director of Finance.
Sec. 4 -17. Financial interest by members, etc.
No member of the Aviation Board, nor any of-
ficer, agent or employee of that Board or the
Aviation Department, shall have a financial in-
terest, direct or indirect, in any contract with
the Aviation Board or be financially interested,
directly or indirectly, in the sale to the Board
of any land, materials, supplies or services.
Sec. 4 -18. Assistance from other City Departments.
Wherever feasible, the Aviation Department
shall utilize the specialized talents and services
of the other City departments. The City Attorney
shall be the legal officer of the Aviation Board
and of the Aviation Department and shall handle
such legal matters as may come before them as
required by the Charter. The Director of Public
works shall furnish such engineering services as
are necessary in the conduct of the affairs of the
Aviation Department, as required by the Charter.

Sec. 4 -19. Conflicts with other departments to
be resolved by City Council.
In the event of any conflict of jurisdiction
arising between the Aviation Department and any
other board or department of the city govern-
ment, or in regard to any administrative detail
thereof, the same shall be referred to the City
Council, and its decision shall he final.
SECTION 2.
That this ordinance shall be in full force and effect
from and after the date of its passage, and it is so ordained.
