HomeMy WebLinkAboutOrdinance 16932-05-2006ORDINANCE NO. 16932-OS-200b AN ORDINANCE AMENDING SECTIONS 35-56(c) OF CHAPTER 35 OF THE CODE OF T1rIE CITY OF FORT WORTH (1986), AS AMENDED, BY REVISING AND ADDING CERTATiN RATES AND CHARGES; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES AND PROVISIONS OF THE FORT WORTH CITY CODE IN CONFLICT HEREWITH; PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVEI2ABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH: SECT>l®I®T 1. That Section 35-56{c) of Chapter 35 of the Cade of the City of Fort Worth (198b), as amended, is hereby azx~ended to be and read as follow: "{c) The following schedule of rates per zr~.a~ath ar fraction. thereof shall be the basis for determining charges to all customers for re~adering, sanitary sewerage service, where the sewage produced by such customer is a normal strength wastewater [two hundred ten (210) mg/l B.O.D. and two hundred forty {240) mg/l suspended solids and where such customer is located within the city: RATES FOR SEWERAGE SERVICE ONLY (1) A monthly service charge shall be charged to all customers in the amount of four dollars and fifty cents ($4.50). {2) A monthly volurr~e charge shall also be charged to residential customers in the amount of two dollars and fifty-one cents ($2.51) per one hundred (100) cubic feet of water used, axad to nonresidential/nan- zx~onitored customers in the aanount of two dollars and seventy-seven. cents ($2.77) per one hundred {100) cubic feet of water used, ar wastewatex produced, as more specifically set Earth hereinafter. The mantlaly volume charges for residential class cusiomers will be based on the individual customer's average monthly water use during the preceding winter quarter months of December, January and February multiplied by ninety-two (92) percent, but in na event shall the volume used to compute this monthly charge for a single family residential unit or a duplex unit exceed one thousand five hundred (1,500) cubic feet. The volumes used to compute these charges are based on the amount of water used by the residential class customer as measured by a meter. Where no preceding winter quarter average is available from records, the director shall estimate a volume to be used for this monthly volume charge. The monthly charges to floe nonresidential/non-zmonitored customers will be based on total water use as measured by appropriate meters, with the provision that if a customer can prove, to the satisfaction of the director, that a significant portion of the metered water usage does not enter the sanitary sewers, the customer will be charged for only that volume entering the sewers, as determined by a method approved by the director." SECTION 2e This ordinance shall be cuaxzulative of all provisions of ordinances and of the Code of the City of Fnrt Wo~•th, Texas (198b), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which. event conflicting previsions of such ordinances and such Code are hereby repealed. SECTION 3e It is hereby declared to be the intezation of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall. be declared unconstitutional by the valid judgment or decree of any court of cozmpetent jurisdiction, such unconstitutionality shall not affect any of the rezmaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4. This ordinance shall take effect on April 2006. Adapt Ordinance Revising Calculation of Retail Residential Wastewater Winter Quarter Average Volumes for Billing for the Period of April 2006 through March 2007 RECOMMEN©ATlON: It is recommended that the City Council adopt the attached ordinance, which revises the calculation of retail residential wastewater winter quarter average volumes for billing for the period April 2006 through March 2007. ®IS~I~.S~ION: In accordance with Ordinance Number 16624-09-2005, rnanthly wastewater volumes far residential customers are currently calculated based an the customer's average monthly water use during the preceding winter quarter months of December, January and February. The purpose of this calculatinn is to determine indoor water use, which is correlated to the amount of wastewater discharged into the sewer system. The established volume is then multiplied by the established rate to determine the customer's wastewater charge. The ordinance also limits the volume that can be billed to a residential customer by setting a cap of 1,500 cubic feet. Although this calculation is designed to capture non-irrigatian uses, many residential customers increased their water usage during the 2005-06 winter months for outside irrigatian purposes in response to recent drought conditions. Recognizing the impact of outdoor watering nn wastewater charges, staff researched options to mitigate that impact. City staff surveyed other local utilities to determine if similar actions were being taken and what mechanisms could be employed. In addition, staff analyzed historical data to determine use under mare normal weather conditions in an attempt to isolate the component of this year's average winter quarter calculation that could be attributed to increased outdoor water use. As a result, staff recommends that the retail residential wastewater winter quarter average volume calculation be based an the individual customer's average monthly water use during the preceding winter quarter months of December, January and February multiplied by 92 percent. In na event shall the volume used to compute this monthly charge far a single family residential unit or a duplex unit exceed 1,500 cubic feet. By adjusting the winter quarter average to 92 percent of the calculated winter quarter average, Fort Worth is projected to generate sufficient revenues to recover its wastewater cost of service, while normalizing the impact of high water use in the winter months on residential customers. This change shall be effective until the calculatianlimplementatian of the 2007 retail residential wastewater winter quarter average.
