TO CITY SECRETARY CONTRACT
WIME�. ,FAS, the City of Fort Worth (CITY) and Freese and Nichols ,
Inc. , (ENGINEER) made and entered into City Secretary Contract No.
55399, (the CONTRACT) which was authorized by M&C 21-0128 on the 16th
day of February, 2021 in the amount of $1,001 ,447 . 00; and
�f7i�F7 MAS, the CONTRACT involves engineering services for the
following project:
3rd Barrel Parallel Sanitary Sewer to the Twin 90-inch Sewers Serving
the Village Creek Wastewater Treatment Plant, Bank Protection at the
Village Creek Wastewater Treatment Plant and Pipeline Erosion
Analysis at Five Low Water Crossings Project; and
WIEEMAS, it has become necessary to execute Amendment No. 1 to
the CONTRACT to include an increased scope of work and revised fee .
NOWTEUERFFORE, CITY and ENGINEER, acting herein by and through
their duly authorized representatives, enter into the following
agreement, which amends the CONTRACT:

Article I of the CONTRACT is amended to include the additional
engineering services specified in the proposal attached hereto and
incorporated herein. The cost to City for the additional design services
to be performed by Engineer totals $94 ,871 . 00 (Sewer) .
2 .
Article II of the CONTRACT is amended to provide for an increase
in the fee to be paid to Engineer for all work and services performed
under the Contract, as amended, so that the total fee paid by the City
for all work and services shall be an amount of $1 ,096,318 . 00.
3 .
All other provisions of the Contract, which are not expressly
amended herein, shall remain in full force and effect.

Dear Ms. Poudyal:
Freese and Nichols, Inc. (FNI) is providing this proposal to amend the Engineering Design Services for the
3rd Barrel/Village Creek Bank Stabilization/5 Sites (City Project Number 103128).The following fee
includes the costs for the preparation of an Individual Permit for the USACE, additional design efforts to
comply with the IP, and credits for a reduction in geotechnical investigation, coordination with USACE
under Nationwide Permit No.13, and the deletion of Site No.2 Verna Trail/ Live Oak technical
memorandum. FNI records show that this proposal would serve as Contract Amendment No. 1.

AND PIPELINE EROSION RISK ANALYSIS FOR 5 SITES
AMENDMENT NO.1
The scope set forth herein defines the work to be performed by the ENGINEER in
completing the project. Both the CITY and ENGINEER have attempted to clearly define the
work to be performed and address the needs of the Project. Task Nos. 1-15 previously
defined under the original contract. The purpose of this amendment is to amend Task 8.0
(Village Creek Bank Analysis) by including additional effort for obtaining an Individual Permit
(IP) from the USACE for the Village Creek Bank Analysis and to amend Task 9.0 (Village
Creek Plan Development) by including additional effort for the scope increase in the design
of the bank stabilization as a result of the USACE IP. In addition, effort not needed as a
result of the USACE IP includes the reduction in effort for geotechnical investigations (Task
9.7), environmental permitting and support (Task 9.8) for original design under Nationwide
Permit 13, and the deletion of effort for development of a technical memorandum for Site
No.2 (Verna Trail / Live Oak) (Task 11.0)

TASK 8.7. USACE INDIVIDUAL PERMIT.
The Engineer will prepare an Individual Permit in compliance with USACE requirements for
the design of the bank stabilization adjacent to the Village Creek Water Reclamation Facility.
The duties and responsibilities of the Resident Project Representative are as follows:
■ Document preparation including executive summary, identification of project location
and nature of activity, defining the construction schedule, defining the purpose and
need for the project, alternatives analysis comparison, alternatives analysis report
section and summary narrative, description of avoidance and minimization.
■ Description of Jurisdictional Determination (JD).
■ Reviewing TXRAM (existing condition/site visits and post project).
■ Description of native vegetation, 100-year floodplain, existing soils and geology,
stream geomorphology.

■ Description of threatened and endangered species and indirect and cumulative
effects.
• Description of proposed mitigation and ecological trajectory.
■ Description of public interest factors.
■ Description of recommended actions (conclusions).
■ Performing internal quality control and formatting of permit.
■ Preparation of USACE forms, IP checklist, ENG Form 4345, and Errata Sheet. Due
to the nature of the improvements and location of the site located within City of Fort
Worth property, it is anticipated that no public comments and/or opposition will be
received, during the public comment phase, requiring redesign of the project.
■ Additional meetings with City and USACE.
■ Address comments from City, USACE and other Agencies.
■ Description of cultural resources.
■ Additional tree, bank and stream surveying.
DELIVERABLES
A. Permit application for City review and submittal to USACE.
TASK 9.10. ADDITIONAL DESIGN DUE TO USACE IP.
The Engineer will provide additional design for the bank stabilization in compliance to the
USACE IP. The duties and responsibilities of the Engineer are as follows:
■ Additional geomorphic design effort.
■ Preparation of riverbed grading.
■ Preparation of a vegetative planting plan.
■ Preparation of an RCP outfall design plan.
■ Preparation of special specifications.
■ Design of additional river length.

TASK 9.7. GEOTECHNICAL INVESTIGATIONS.
The original bank stabilization concept required an extensive geotechnical investigation
including a slope stability analysis. The revised concept does not require the same level of
geotechnical analysis. As a result, a credit of$10,000 is included in this Amendment No.1.
TASK 9.8. ENVIRONMENTAL PERMITTING AND SUPPORT.
The original bank stabilization concept required coordination with the USACE under the
Nationwide Permit (NWP) No.13. The revised concept requires significant coordination with
the USACE per the development of an Individual Permit (IP). Amendment No.1 includes the
full effort required for development of the IP. As such, the effort required for NWP 13
coordination will not be required. As a result, a credit of$20,000 is included in this Amendment
No.1.
TASK 11.0. SITE No.2 (VERMA TRAIL / LIVE OAK CREEK).
After a preliminary analysis and site visit to Site No.2, it was determined that modification to
this sewer main would require a larger construction project than was initially anticipated. The
City elected to remove this site from the Technical Memorandum and instead address the
operational concerns under a separate project. As a result, the remaining effort not used will
be returned to the City, as a credit of$10,000, and is included in this Amendment No.1.
ADDITIONAL SERVICES NOT INCLUDED IN THE EXISTING SCOPE OF SERVICES
Additional Services not included in the existing Scope of Services — Refer to original
contract for additional services not included in the scope of services.
