HomeMy WebLinkAboutOrdinance 25157-10-2021ORDINANCE NO. 25157-10-2021 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS OPERATING OTHER FUND IN THE AMOUNT OF $183,082.62, FROM REPURPOSED FUNDS RECEIVED FROM THE SUMMER SERVICE PROGRAM, FOR THE PURPOSE OF FUNDING AUGMENTATION OF OTHER COMMUNITY SERVICES PROGRAMS WITHIN THE NEIGHBORHOOD SERVICES DEPARTMENT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2021-2022 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Operating Other Fund in the amount of $183,082.62, from repurposed funds received from the Summer Service Program, for the purpose of funding augmentation of other Community Services Programs within the Neighborhood Services Department. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be incorporated into the ordinance effecting the budget of the municipal government of the City of Fort Worth for the ensuing Fiscal Year beginning October 1, 2021, and ending September 30, 2022, and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the use of the Summer Food Service Program funds in the amount of $183,082.62 to augment other community services programs within the Neighborhood Services Department; and 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Operating Other Fund, in the amount of $183,082.62, from repurposed funds received from the Summer Food Service program, for the purpose of funding augmentation for other community services programs within the Neighborhood Services Department. DISCUSSION: The City of Fort Worth (City) has participated in the Summer Food Service Program through several State of Texas Departments (the last being the Texas Department of Agriculture) since 1982 whereby the City administered meals, snacks and beverages for children living in Tarrant County during the summers. In 2019, the Tarrant Area Food Bank took over the program since it was more cost-effective for the City. Over time, the City accumulated $172,829.71 in unused reimbursements (the difference between the amount of reimbursement eamed and received and allowable costs, when reimbursement exceeds costs). These funds are held in an account that also earned interest in the amount of $10,252.91 and accumulated for a total amount of $183,082.62. The Summer Food Service Program final rule states, "If a sponsor does not return to participate in the Summer Food Service Program and does not operate any other Child Nutrition Programs, the sponsor is not required to return the unused reimbursement." The Texas Department of Agriculture does not determine how the Summer Food Service Program funds will be used by contracting entities that no longer participate in the Summer Food Service Program. Contracting entities are advised to follow their internal policy and procedures as to how to use the funds. The Texas Department of Agriculture does not have any reporting requirements. The Neighborhood Services Department would like to use these funds along with other resources for its community -based activities within Tarrant County through the Community Action Partners. These activities are: 1. Utility assistance 2. Rental or mortgage assistance 3. Home repairs 4. Career assistance A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that funds are available in the current operating budget, as appropriated, in the Grants Operating Federal Fund, and upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the Grants Operating Other Fund. Prior to any expenditures being incurred, the Neighborhood Services Department has the responsibility to validate the availability of funds.
