HomeMy WebLinkAboutContract 17486 CITY SECRE ARY CONTRACT NM(a INTERLOCAL AGREEMENT WHEREAS, the City of Fort Worth desires to make certain water and sewer improvements to its Pecan Valley Golf Course; and WHEREAS, a portion of. the City of Fort Worth Pecan Valley Golf Course lies within the jurisdiction of the Benbrook Water and. Sewer Authority; and WHEREAS, the City of Fort Worth desires the Benbrook Water and Sewer Authority perform the water and sewer improvements within its jurisdiction; and WHEREAS, the Benbrook Water and Sewer Authority is agreeable to contracting for these water and sewer improvements within its jurisdiction; and WHEREAS, the City of Fort Worth has prepared or caused to be prepared the necessary plans and specifications for the construction of these water and sewer improvements ; and WHEREAS, in accordance with the applicable state law and city ordinances , the City of Fort Worth has advertised for bids to be taken for the construction of the water and sewer improvements ; and WHEREAS, Steed, Inc . , was the low responsible bidder to the plans and specifications; and WHEREAS , Stead, Inc. , agreed to perform that portion of the water and sewer improvements located within the jurisdiction of the Benbrook Water and Sewer Authority for the sum of $15 , 120 . 00 . NOW, THEREFORE, this agreement is entered into by and between the City of Fort. Worth, hereinafter referred to as "City" , and the Benbrook Water and Sewer Authority, hereinafter referred to as "B14SA" . I BWSA agrees to enter into a contract with Steed, Inc . , in the amount of $15 ,120 .00 for Steed, Inc. , to perform certain water and sewer improvements to benefit the City `s Pecan Valley Golf Course in compliance and in accord with the plans and specifications attached hereto as Exhibit "A" . II The City shall pay to BWSA seven and one-half (7 1/2) percent of the final contract price between BWSA and Steed, Inc . , for inspection and administration of the contract . As of the date of this agreement , the cost for administration and inspection is $1 , 134.00 . III BWSA agrees that it will not enter into any change orders which affect the contract between BWSA and Steed, Inc. , without the prior written approval of City . Upon approval , City shall pay to BWSA the cost of such change orders and the percentage as provided for in paragraph II hereof for Administrative and inspection costs . IV City agrees to pay to BWSA within a reasonable time after the execution of this agreement the sum of $16, 254 .00 , representing the contract price and inspection and administration costs . City understands that commencement of work will not be effected until payment is made to BWSA. V Upon completion of the work contemplated herein, BWSA, at it sole cost and expense, shall be responsible for the operation and maintenance of the water and sewer lines within its jurisdiction. City shall never have any responsibility for the operation and maintenance of such water and sewer improvements . VI Nothing contained herein shall be construed as creating a joint venture or partnership between City and BWSA. Other than BWSA' s obligations contained in paragraph V hereof , this agreement shall terminate upon the completion of the installation of the improvements contemplated herein. Project Nos. are 56-013025-00 and 83-015027-00. DISCUSSION: On October 17, 1989, the City Council approved M&C C-11940 to award a con- tract for water and sanitary sewer improvements to Pecan Valley Golf Course. Part of this project includes an Interlocal Agreement with the Benbrook Water and Sewer Authority (BWSA) for the amount of construction in Benbrook plus 7-1/2% for inspection and administration . An error was made on the above mentioned M&C, using a 7% figure instead of 7-112%. The amount of the Inter- local Agreement should read $15,120 for construction, $1,134 for inspection and administration, for a total of $16 ,254. The Interlocal Agreement will also provide that BWSA will not execute its contract with the general contractor until payment has been made to BWSA. FINANCING: Sufficient funds are available in Golf Fund 39, Account No. 80-41-10, Pecan Valley Golf Course , Greens Maintenance , and Account No . 80-40-05 , Administration Golf Courses .
