AMENDMENT No.2
TO CITY SECRETARY CONTRACT
WIIEREAS, the City of Fort Worth (CITY) and CDM Smith, Inc. ,
(ENGINEER) made and entered into City Secretary Contract No. 52517 ,
(the CONTRACT) which was authorized by M&C C-29181 on the 25th day
of June, 2019 in the amount of $192 , 600 .00;
WHEREAS, the CONTRACT was subsequently revised by Amendment
No. 1 in the amount of $97,448 . 00 administratively authorized May
29, 2020; and
WHEREAS, the CONTRACT involves engineering services for the
following project:
Westside Water Treatment Plant Plate Settler Expansion; and
WHEREAS, it has become necessary to execute Amendment No. 2 to
the CONTRACT to include an increased scope of work and revised
fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and
through their duly authorized representatives, enter into the
following agreement, which amends the CONTRACT:

Article I of the CONTRACT is amended to include the additional
engineering services specified in a proposal letter attached hereto
and incorporated herein. The cost to City for the additional design
services to be performed by Engineer totals $141,740 . 00 .
2 .
Article II of the CONTRACT is amended to provide for an increase
in the fee to be paid to Engineer for all work and services
performed under the Contract, as amended, so that the total fee
paid by the City for all work and services shall be an amount of
$431,788 . 00 .
All other provisions of the Contract, which are not expressly
amended herein, shall remain in full force and effect.

Dear Mr.Taylor:
CDM Smith was requested to provide additional engineering services during construction for the
referenced project. These services include providing on-site inspection services. We will also
provide construction related activities,such as shop drawing review and RFI responses related to
the additional design scope of work from Amendment No.1. We request an amendment to our
current contract for performing these additional services.The attached scope of work provides a
more detailed explanation for these additional engineering services during construction. Also
attached is our fee proposal table developed for the additional scope of work.
The total requested fee for the additional engineering services during construction is$141,740,
This fee is broken down as follows:
• CDM Smith $124,940
• Gupta&Associates $ 16,800
The not-to exceed amount of the current agreement would be modified as follows:
• Original Agreement Amount: $192,600.00
• Amendment 1 Amount: $ 97,448.00
• Amendment No.2 Amount: $141,740.00
• Revised Agreement Amount: $431,788.00
Note that we have based the on-site resident project representative (RPR) effort on an average of
eight hours per week for 56 weeks of construction. CDM Smith will provide an RPR to be full-time
on-site for the duration of construction,but he will only charge bill time actually spent on the

project. Sterling Gerlock is the proposed RPR. He will be supported by senior engineering staff
from CDM Smith and Gupta and Associates as needed,specifically for process mechanical,electrical
and instrumentation and control work.

SCOPE OF SERVICES
FOR
WESTSIDE WATER TREATMENT PLANT
PLATE SETTLER EXPANSION PROJECT
AMENDMENT NO. 2
Background
CDM Smith contracted with the City of Fort Worth for the Westside Water Treatment Plant
(WSWTP) -Plate Settler Expansion Project. The initial scope of work included development of
design for adding additional plate settlers to the three sedimentation basins at the WSWTP to
expand their capacity from the existing 15 MGD capacity to 18 MGD. Amendment No.1 to the
contract was executed to provide additional design and construction services for the electrical and
instrumentation design for the addition of Filter No.5 and any coordination of changes related to
the membrane addition. Amendment No.1 also included additional design services for the
following items:
■ Replace the existing raw water transit time meter and flow control valve with a magnetic
flow meter for better accuracy,
■ Provide an additional membrane feed pump with variable frequency drive,and
■ Relocate the potable water sample point following the clearwell storage tank.
Amendment No.1 did not include any additional engineering services during construction related
to shop drawing review and RFI responses for civil and process-mechanical items associated with
Filter No. 5,the raw water meter and flow control valve,the membrane feed pump,or the potable
water sample pump.
The original contract and Amendment No.1 includes four construction meetings and two site visits
throughout the 13-month construction period. It does not include any on-site inspection services.
This proposal presents the additional scope of work and engineering fee for providing additional
engineering services during construction. CDM Smith will provide an on-site resident project
representative (RPR)for the entirety of the construction project,supported as needed by senior
technical staff,with partial/limited observation of work based on 8 hours of observation per week
(RPR will be engaged in other work during other periods). CDM Smith will also provide submittal
reviews related to the additional design scope from Amendment No.1. Gupta and Associates,Inc.
(GAI)will provide as-needed inspection services related to electrical and instrumentation work.
Scope of Work
The scope of work presented below describes the additional engineering services to be provided
tinder this Amendment No. 2 by Task.
Task 1-Project Management
CDM Smith will provide additional engineering services related to day-to-day management of the
project for an additional 10 months beyond the originally planned construction completion date of

August 2020,as shown in the contract project schedule.
Task 2 —Basis of Design Memorandum
No changes in scope of work.
Task 3 —TCEQ Coordination
No changes in scope of work.
Task 4— Final Design
No changes in scope of work.
Task 5—Bidding Phase Services
No changes in scope of work.
Task 6— Construction Phase Services
Task 6.1 Construction Support
■ The ENGINEER shall provide additional provide review of shop drawings for the
additional process-mechanical and civil work associated with the items identified in the
Background Section of this Amendment No.2. It assumed that an additional 10 shop
drawings and four RFIs will be submitted by the Contractor for this additional work.
■ The ENGINEER shall provide additional review and response to Contractor requests for
information for the process-mechanical and civil work associated with the items
identified in the Background Section of this Amendment No.2. It is assumed than an
additional 4 RFIs will be submitted by the Contractor for this additional work.
■ The ENGINEER shall receive and track all shop drawing submittals (shop drawings and
RFIs) and maintain shop drawing log on BIM360.
■ The ENGINEER shall provide the services of an engineer for on-site resident project
representation(RPR) and review of work throughout the construction contract.
Engineer will review the quality of work,respond to field questions from the Contractor,
and prepare a summary report for each day on-site. The on-site representative will be
located at the Westside WTP site for the entirety of the construction period (S6 weeks).
It is assumed that the RPR will spend an average of eight hours per week on work
specific to this project.
■ The RPR will supported by senior level engineering staff on an as-needed basis during
construction to provide inspection services related to process-mechanical,electrical and
instrumentation phases of the project. It is estimated that a total of 40 hours will be
provided for process-mechanical work;80 hours for electrical work;and 48 hours for
instrumentation work. This work will be provided during the specific periods when
these areas of construction are being performed.
Limits of On-Site Representation Responsibility: The purpose of on-site
representation during the project will be to enable ENGINEER to carry out the duties
and responsibilities assigned and undertaken by ENGINEER during the Construction

Phase,and,in addition,by the exercise of ENGINEER's efforts as an experienced and
qualified design professional,to provide the CITY with a greater degree of confidence
that the completed work will conform to the Contract Documents and that the
Contractor and its Subcontractors have implemented and maintained the integrity of
the design concept of the completed Project as a functioning whole as indicated in the
Contract Documents.ENGINEER shall not be assumed to have reviewed work
undertaken and covered or buried when not on site. ENGINEER will not,during such
visits or as a result of such observations of the contractor's work in progress,supervise,
direct,or have control over the Contractor or its Subcontractor's work,nor shall
ENGINEER have authority over or responsibility for the means,methods,techniques,
sequences,or procedures of construction selected or used by the Contractor,for
security or safety on the site,for safety precautions and programs incident to the
Contractor's or its Subcontractors work,nor for any failure of the Contractor or its
Subcontractors to comply with Laws and Regulations applicable to the Contractor
furnishing and performing the work.
Compensation
The total requested amount of this proposed Amendment No.2 is$141,740 per attached Fee
Development Spreadsheet.
The Labor Rate Schedule shall be revised to include hourly billing rates for 2021 and 2022 as
shown below.

Schedule
The project schedule for work associated with this Amendment No.2 will run concurrently with the
construction schedule,estimated to start on July 1,2021 and completing in 400 calendar days on
July 31,2022.

RECOMMENDATION:
It is recommended that the City Council:
1. Authorize execution of Amendment No.2 to City Secretary Contract No.52517 in the amount of$141,740.00,an engineering agreement
with CDM Smith, Inc.for construction support services for Westside Water Treatment Plant Plate Settler Expansion project for a revised
contract amount of$431,788.00;
2. Authorize execution of a contract with Crescent Constructors,Inc.in the amount of$3,697,000.00 for the Westside Water Treatment Plant
Plate Settler Expansion project;
3. Adopt the attached appropriation ordinance increasing receipts and appropriations in the Water Impact Fee Fund in the amount of
$4,191,569.00 from available funds for the purpose of transferring funds from the Water/Wastewater Wholesale Impact Fees and
Water/Wastewater Retail Impact Fee projects(City Project Nos. B20004 and B20005)to the Westside Water Treatment Plant Plate Settler
Expansion project;and
4. Adopt the attached appropriation ordinance increasing receipts and appropriations in the Water Impact Fee Fund in the amount of
$4,191,569.00 transferred from within the Water Impact Fee Fund to the Westside Water Treatment Plant Plate Settler Expansion project
(City Project No. 102052).
DISCUSSION:
On June 25,2019,Mayor and Council Communication(M&C C-29181)authorized an engineering agreement with CDM Smith, Inc.,(City
Secretary Contract No.52517), in the amount of$192,600.00 for the Westside Water Treatment Plant Plate Settler Expansion project. The
agreement was subsequently revised by Amendment No.1 administratively authorized May 29,2020,to provide additional design for the
replacement of the raw waterflow meter,the addition of filter No.5,the addition of membrane feed pump No.5 and relocating the finished water
sample point. As part of Amendment No.2,the engineer will perform construction support services for construction of the project that includes
shop drawings and submittals reviews,change order review,record drawings and update plant operational manual in the amount of$141,740.00.
Construction of the project was advertised for bid on March 4,2021 and March 11.2021 in the Fort Worth Star-Telegram.On April 1,2021,the
following bids were received:

In addition to the contract cost,$167,979.00 is required for project management,material testing and inspection and$184,850.00 is provided for

on this project.The City's goal on this project is six percent.

FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that funds are currently available In the W/WW Wholesale Impact Fees and W/WW Retail Impact Fees projects
within the Water Impact Fee Fund and approval of the above recommendations and adoption of the attached appropriation ordinances,funds will
be available in the Water Impact Fee Fund for the Westside WTP Plate Settlers project to support the approval of the above recommendations
and execution of the amendment to the agreement,Prior to an expenditure being Incurred,the Water Department has the responsibility of verifying
the availability of funds.
