AN ORDINANCE AMENDING CHAPTER 22 "MOTOR
VEHICLES AND TRAFFIC," ARTICLE III "OPERATION
OF VEHICLES," SECTION 22-86 "SPEEDING,"
SUBSECTION (i) OF THE CODE OF THE CITY OF FORT
WORTH, TEXAS (2015), AS AMENDED, TO CHANGE THE
LOCATIONS, EXTENT, AND SPEED LIMITS OF CERTAIN
SPEED ZONES; PROVIDING THAT THIS ORDINANCE
SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES
AND REPEAL CONFLICTING ORDINANCES;
PROVIDING FOR A SAVINGS CLAUSE; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING A PENALTY
CLAUSE; PROVIDING FOR PUBLICATION; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Fort Worth's Transportation and Public Works (TPW)
Department routinely reviews the speed limits in the Code of the City of Fort Worth, Texas (2015),
as amended, ("City Code") in order to make corrections, additions or amendments, where
appropriate;
WHEREAS, the TPW Department desires to amend the speed zone tables included in the
City Code to provide for adjustments as a result of development and to make text, speed limit, and
block range corrections;
WHEREAS, Texas Department of Transportation staff completed speed surveys
(engineering and traffic investigations), which took into consideration the width and condition of
the pavement, other circumstances on that portion of roadway, and the usual traffic on it, to show
that any prima facie speed limit set by statute is greater or less than is reasonable or safe under the
conditions found to exist at any intersection or on any part of the roadway system under the City's
jurisdiction;
WHEREAS, the Texas Transportation Code Section 545.356 specifies the procedures for
a municipality to set speed zones and to post speed limits; and
WHEREAS, this ordinance incorporates the above recommendations and amends the
Speed Zone Tables of Chapter 22 "Motor Vehicles and Traffic," Article III "Operation of
Vehicles," Section 22-86 "Speeding," Subsection (i) of the City Code as recommended by the
TPW Department;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF FORT WORTH, TEXAS, THAT:

Chapter 22 "Motor Vehicles and Traffic," Article III "Operation of Vehicles," Section 22-86
"Speeding," Subsection (i) of the Code of the City of Fort Worth, Texas (2015), as amended, is hereby

SECTION 2.
This ordinance shall be cumulative of all provisions of ordinances of the Code of the City of
Fort Worth, Texas, (2015), as amended, except where the provisions of this ordinance are in direct
conflict with the provisions of such ordinances and such Code, in which event conflicting provisions
of such ordinances and such Code are hereby repealed.

Section 22-86, Subsection (i) Speeding
SECTION 3.
It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences,
paragraphs and sections of this ordinance are severable, and, ifanyphrase, clause, sentence, paragraph
or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any
court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases,
clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted
by the City Council without the incorporation in this ordinance of any such unconstitutional phrase,
clause, sentence, paragraph or section.
SECTION 4.
All rights and remedies of the City of Fort Worth, Texas, are expressly saved as to any and all
violations of the provisions of the Code of the City of Fort Worth, or any other ordinances of the City,
that have accrued at the time of the effective date of this ordinance; and, as to such accrued violations
and all pending litigation, both civil and criminal, whether pending in court or not, under such
ordinances, same shall not be affected by this ordinance, but may be prosecuted until final disposition
by the courts.
SECTION 5.
Any person who violates, disobeys, omits, neglects, or refuses to comply with or who resists
the enforcement of any of the provisions of this ordinance shall be fined an amount not exceeding two
hundred dollars ($200.00) for each offense.
SECTION 6.
The City Secretary of the City of Fort Worth, Texas is hereby directed to publish the caption,
penalty clause and effective date of this ordinance for two (2) days in the official newspaper of the
City of Fort Worth, Texas, as authorized by Texas Local Government Code, Section 52.013.
SECTION 7.
All other provisions of Chapter 22 of the Code of the City of Fort Worth, Texas, (2015), as
amended, shall remain in full force and effect, save and except as amended by this ordinance.

This ordinance shall take effect upon adoption and publication as required by law, and it is so
ordained.

RECOMMENDATION:
It is recommended that City Council adopt the attached ordinance amending Chapter 22 "Motor Vehicles and Traffic," Article III "Operation of
Vehicles," Section 22-86 "Speeding," Subsection (i) of the Code of the City of Fort Worth, Texas (2015), as Amended, to change the roadway
limits, block ranges and speed limits of certain speed zones specifically, to change the designation of IH-30 (East Freeway) from Clover Lane to
East City Limits to Main Street to East City Limits, to change the designation of IH-30 (West Freeway) to Main Street to West Fort Worth City
Limits, to change block ranges and establish speed limits.
DISCUSSION:
The purpose of this Mayor and Council Communication (M&C) is to amend the city code of ordinances to reflect the correct extents, block ranges,
and speed limits for IH-30 a/k/a East and West Freeways. Currently, the city code designates Clover Lane as the divider between East and West
Freeway; however, Main Street is the actual dividing line, as confirmed by the Fire Department and a review of historical records. In addition, block
range corrections are needed for all East and West Freeway segments and a speed limit adjustment is needed for West Freeway to establish 65
MPH on the segment from Clover Lane to Longvue Ave (RM 2871).
This M&C does not change posted speed limits on East and West Freeway and no additional signage is required.
A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity.

The Director of Finance certifies that approval of this recommendation will not have any material effect on City Funds.
