to CITY SECRETARY CONTRACT No. 48433
WHEREAS, the City of Fort Worth (CITY) and Dunaway Associates L.P. ,
(ENGINEER) made and entered into City Secretary Contract No. 48433, (the
CONTRACT) which was authorized by City Council (M&C C-27993) on November
15, 2016, in the amount of $319,845 .00; and
WHEREAS, the CONTRACT was subsequently revised by: Amendment Number
1 in the amount of $99,598 .00, which was administratively authorized on
February 1, 2018; and
WHEREAS, the CONTRACT was subsequently revised by: Amendment Number
2 in the amount of $99,825 . 00, which was authorized by City Council (M&C
C-29112) on May 7, 2019; and
WHEREAS, the CONTRACT involves engineering services for the
following project:
CO2447 - FOREST PARK - ZOO DRAINAGE IMPROVEMENTS; and
WHEREAS, it has become necessary to execute Amendment No. 3 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement,
which amends the CONTRACT:

Article I of the CONTRACT is amended to include the additional
engineering services specified in proposal attached hereto and
incorporated herein. The cost to CITY for the additional design services
to be performed by ENGINEER totals $18,000 .00. (See Attached Funding
Breakdown Sheet, Page -4- )
2 .
Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $537,268 .00.
3.
All other provisions of the Contract, which are not expressly
amended herein, shall remain in full force and effect. OFFICIAL RECORD

Dunaway "Standard Terms & Conditions," under the original Agreement dated
December 5, 2016.

Client hereby requests and authorizes Dunaway Associates, LLC (Dunaway) to perform
the following additional services:
DETAILED SCOPE OF WORK
1 . ONCOR Easement - By Separate Instrument...............................$3,500.00 Lump Sum
Dunaway will prepare the metes and bounds description with exhibit for the re-
route of the existing overhead electric lines crossing through Forest Park to
underground as depicted in the park land conversion exhibit (attached.) The
easement will require reference to the Forest Park boundary and requires one-day
of field work. Owner to provide application and fee payment to ONCOR.
2. Separate Instrument- Private ONCOR Easement.......................$2,500.00 Lump Sum
Dunaway will prepare one (1) easement necessary for the ONCOR electric line.
Dunaway will prepare the legal metes and bounds description and exhibits for one
(1) private ONCOR electric easement.

3. Letter of Map Revision Application...............................................$12,000.00 Lump Sum
This Task will include the preparation, submittal, coordination, and
correspondence necessary for the application to FEMA for a letter map revision
(LOMR). Specific sub-tasks related to the submittal are as follows:
a. Prepare Required FEMA Forms. This work will consist of the completion of the
applicable FEMA forms required for the submittal which include property
information, hydrologic/hydraulic data, and acknowledgement from the local
floodplain administrator that the changes are compliant with FEMA's
standards. This task will also include the necessary forms to address the aspects
of the CLOMR required by the FEMA Floodplain Administrator.
b. Prepare Engineering Report (i.e. Narrative). The narrative will address the
pertinent information supporting the application and will provide the necessary
documentation related to the models and will also provide the supporting
documents as required by current FEMA instructions, recommendations, and
guidelines.
C. Prepare Pertinent Exhibits. The exhibits provided with the request for a LOMR,
will consist of, but may not be limited to, a work map depicting the current
effective floodplain, corrected effective floodplain, and the post project flood
plain; a certified topographic map, applicable plats and/or boundary data;
and annotated FIRM Map(s) depicting the proposed changes in the flood
plain.
d. Property Owners Notification. For this sub-task an owner's notification for review
and comment from FEMA will be prepared and submitted for with the request.
This sub-task also assumes the project will result in an increase in the base flood
elevation, BFE. It is noted the notification will be sent to the adjacent
landowners after approval by FEMA.
e. Project Coordination. The work of this sub-task includes coordination with the
Client, design team, the County Flood Plain Administrator, and the FEMA. It will
include one site visit, and two client meetings. In addition, this sub-task includes
the coordination and/or correspondence with the City and FEMA with up to
three (3) review cycles for the City and (3) review cycles with FEMA.
ASSUMPTIONS / EXCEPTIONS:
1. This proposal anticipates up to three (3) review cycles with the client and three (3) with
FEMA for the LOMR.i.e.a total 6 review cycles. Submittal to FEMA will be made using the
FEMA's online Letter of Map Change tool. This tool will allow electronic upload of all forms
and documents for the LOMR including payment of fees.
2. This proposal assumes there are typically long review times for FEMA to process LOMR
requests. With assumption it anticipates the process can take from 4 to 6 months.

3. FEMA requires that a review and processing fee must be submitted for requests involving
the placement of fill within the floodplain area. This fee would be paid by Client and is
not included in the base scope of services. The current FEMA review fee associated with
CLOMRs of this type (CLOMR Based on New Hydrology, Bridge, Culvert, Channel or
Combination Thereof), as published in the Federal Register, dated January 21, 2015 is
$6,500. Likewise,the fee for the LOMR will be$8,500 assuming no significant changes from
the CLOMR to the LOMR application. The FEMA review fees are subject to change and
are outside of Dunaway's control.
DELIVERABLES:
1. Two (2) hard copies of the Draft LOMR application and associated documents will be
presented with one to the flood plain administer for review and one to the Client.
Additional copies will be provided; however, they will be considered as additional
work.
2. Two (2) hard copies of the Final LOMR application and associated documents will be
presented with one to the flood plain administer and the other to the Client for their
records. Additional copies will be provided; however, they will be considered as
additional work.
