AMENDMET NO. 1
TO
CITY OF FORT WORTH CONTRACT 52431
This Amendment No.1 to City Secretary Contract No. 52431 ("First Amendment")
is entered into by and between the City of Fort Worth (hereafter "Fort Worth"), a home rule
municipality in the State of Texas, acting by and through Valerie Washington,its duly authorized
Assistant City Manager, and City of Haslet, a general law municipality in the state of
Texas (hereafter "Haslet") acting by and through Gary Hulsey, its duly authorized Mayor. Fort
Worth and Haslet shall be referred to individually as a Parry and collectively as the Parties.
WHEREAS, Chapter 791 of the Texas Government Code, the "Interlocal Cooperation
Act," authorizes local government entities to enter into interlocal contracts for governmental
purposes;
WHEREAS, the Texas Government Code 791.006 specifically authorizes interlocal
agreements for fire services;
WHEREAS, on June 17, 2019, the Parties entered into City Secretary Contract No.
52431, an interlocal agreement, for Parties to provide automatic and mutual aid fire services
("Agreement");
WHEREAS,the Agreement would be for a one-year term with the Agreement renewing
automatically for additional one-year periods;
WHEREAS, the Parties wish to amend the Agreement to expand the area in Haslet
where Fort Worth is to provide automatic aid response;
WHEREAS, the Parties agree that Haslet will pay Fort Worth $2,000 per response to
the expanded area where Fort Worth is to provide automatic aid response.
NOW, THEREFORE, the Parties, acting herein by the through their duly authorized
representatives, enter into the following agreement:

AMENDMENTS
1. Attachment A of the Agreement is hereby deleted and replaced with the Attachment A
attached to this First Amendment.
2. The Agreement is hereby amended by adding Exhibit 1, attached to this First Amendment,
as Exhibit 1 of the Agreement.
3. Section II of the Agreement titled "Cost Reimbursed" of the Agreement is here by deleted
and replaced with the following language:

Haslet and Fort Worth agree to reimburse each other for actual costs other than ordinary
operating costs incurred by each other in the performance of this Agreement, or as may
otherwise be required by applicable federal or state statute, law, rule, or regulation.
Reimbursement shall be made on an incident-by-incident basis and shall be made
subsequent to a submission of an invoice by the Party incurring costs to the other Party.
Notwithstanding the above, each Party shall be responsible for all costs associated with its
own equipment, including damage and breakage.
The party in whose jurisdiction the incident occurs shall reimburse the responding party
for all costs, including, but not limited to, labor, payroll, equipment damage or use, and
any and all other expenses incurred pursuant to this Agreement after the first operational
period of a response hereunder. For the purposes of this Agreement and for claims for
reimbursement from the appropriate local, state, or federal agency or entity, the first
operational period shall be the first twelve(12)hours from time of dispatch. Personnel who
are assigned, designated or ordered to perform duties pursuant to this Agreement, shall
receive the same wage, salary, pension, and all other compensation and rights for the
performance of such duties,including injury or death benefits, and Workers' Compensation
benefits, as though the service had been rendered within the limits of the entity where he
or she is regularly employed or serves.Moreover, all medical expenses,wage and disability
payments, pension payments, insurance, damage to equipment and clothing, and expense
of travel, food and lodging shall be paid by the entity in which the employee in question is
regularly employed or for whom said individual volunteers,except for those payments each
party is required to pay under this Agreement.
Notwithstanding the foregoing paragraphs in this section, the Parties agree that Haslet with
reimburse Fort Worth $2,000.00 per response to the shaded area indicated in Exhibit 1.
The shaded area in Exhibit I is more commonly known or referred to as LeTara area.
2.
ALL OTHER TERMS SHALL REMAIN THE SAME
All other provisions of the Agreement which are not expressly amended herein shall
remain in full force and effect.
3.
ELECTRONIC SIGNATURE
This Amendment may be executed in multiple counterparts, each of which shall be
an original and all of which shall constitute one and the same instrument. A facsimile copy
or computer image, such as a PDF or tiff image, or a signature, shall be treated as and shall
have the same effect as anoriginal.

I. AUTOMATIC AID RESPONSE
Explanatory note: Upon receipt of the report of an incident requiring response in their respective
cities, the Fort Worth and Haslet fire departments may normally dispatch the level of resources
described in Section LA below to the reported locations. For purposes of this agreement, automatic
aid in the amount of resources described will be dispatched by one city into the other city's
jurisdictional limits or ETJ,if the incident is reported in any of the geographical areas listed below.
Also for purposes of this agreement, "reported" will be defined to mean any telephone calls into
the 911 system, direct telephone calls to the fire department or radio transmissions to the fire and/or
police dispatch centers. Excluded are automatic alarms, unless followed up by one of the above.
A. Fort Worth:
The Fort Worth Fire Department will respond into Haslet with a minimum of one ARFF, Engine,
or Quint Company staffed with a minimum of three personnel, and one Battalion Chief on all
reported emergency incidents within a specified area of the City of Haslet. All such responses are
subject to availability of personnel and equipment. The response shall be in the area of Haslet City
limits listed below:
1. Mapsco Quadrants: 7 E, F, J, K,N, P, and T (The businesses located here
will have an lntermodal Pkwy or Tradewinds Drive addresses within these
Mapsco quadrants).
2. The shaded area in Exhibit"I". The shaded area is more commonly known
or referred to as LeTara area.
I I. MUTUAL AID RESPONSE (non-automatic)
A. Fort Worth:
Calls for assistance during "working" incidents fires shall be given on an "as needed basis", yet
shall not exceed a normal one-alarm assignment as described by the Fort Worth Fire Department.
All such responses are subject to availability of personnel and equipment.
Additional requests for emergency services including Hazmat, Technical Rescue, Dive/Swift
Water, Wildland, etc. will be approved on a case by case basis as approved by the on duty Shift
Commander. All such responses are subject to availability of personnel and equipment.
B. Haslet:
Calls for assistance during "working" incidents shall be given on an "as needed basis" by Haslet
and shall include one engine/quint. All such responses are subject to availability of personnel and
equipment.

HEARING:
SUBJECT: (ALL) Authorize Execution of Amendment No. 1 to City Secretary Contract No. 52431, an
Interlocal Fire Services Agreement with the City of Haslet, to Expand the Fire Services
Provided by the City of Fort Worth to a Designated Area of Haslet and Accept
Reimbursement
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize execution of Amendment No. 1 to City Secretary Contract No. 52431, an Interlocal
Fire Services Agreement with the City of Haslet, to expand the fire services provided by the
City of Fort Worth to an area of Haslet commonly known or referred to as LeTara; and
2. Authorize the acceptance of reimbursements from the City of Haslet into the General Fund
for costs as a result of Fort Worth handling fire and emergency response to the area of
Haslet commonly known or referred to as LeTara.
DISCUSSION:
City Secretary Contract No. 52431 known as the Interlocal Agreement for Fire Services between City
of Fort Worth and City of Haslet provides mutual aid services in response to fires, rescues, and
emergency medical service (EMS) first response calls in each other's jurisdictions by the Fort Worth
and Haslet Fire Departments. In addition to mutual aid services, the City of Fort Worth provides
automatic aid fire services to certain areas in the City of Haslet. The cities of Fort Worth and Haslet
now wish to amend the agreement to expand the area where the Fort Worth Fire Department is to
provide automatic aid for response services for calls in a designated area not easily accessed by the
Haslet Fire Department as outlined in the agreement and referred to as LeTara. The Fort Worth Fire
Department will be reimbursed at a rate of$2,000.00 per response into the area known as LeTara for
an estimated 50 responses per year.
This project will serve ALL COUNCIL DISTRICTS.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that upon approval of the above recommendations and execution of
the amendment to the contract, funds will be deposited into the General Fund. The Fire
Department (and Financial Management Services) is responsible for the collection and deposit of
funds due to the City.
