BAUGH SURVEY NO. 115, LOCATED IN NORTH FORT WORTH ADDITION, AN ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, AS FILED IN VOLUME 63, PAGE 149 TO 152 OF THE DEED RECORDS OF TARRANT COUNTY, TEXAS; CONTAINING APPROXIMATELY 7,910 SQUARE FEET OR 0.182 ACRE OF LAND; PROVIDING FOR REVERSION OF FEE IN SAID LAND; THE RETAINMENT OF EXISTING UTILITY EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION :I. That a thirty (30) foot wide alley right-of-way, situated in the J. Baugh Survey Abstract No. 115 and being a portion of North Fort Worth Addition (apparent Marine Park), an addition to the City of Fort Worth, Tarrant County, Texas as recorded in Volume 63, Page 149 to 152 of the Deed Records of Tarrant County, Texas; containing approximately 7,910 square feet or 0.182 acres of land more or less, and as more specifically described in Exhibits "A" and "B" attached hereto and incorporated herein by reference be and the same is vacated and extinguished. SECTION 2. That the fee to the land in the above-described vacated alley are hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. That all existing utility easements shall be retained by the City. Ordinance No.20600-02-2013 Page t of 2 SECTION 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5. That this ordinance shall take effect upon adoption. Baugh Survey, Abstract Number 115 City of Fort Worth Tarrant County, Texas BEING a portion of North Fort Worth Addition (Apparent Marine Park), according to the plat recorded in Volume 63, Page 149 to 152, Deed Records of Tarrant County, Texas; BEGINNING at a point in the southwest right-of-way line of Ellis Avenue (80' right-of- way) from which a 5/8-inch iron rod with cap marked "JEA/HYDROTECH SURVEY MARKER" bears South 39 degrees 40 minutes 25 seconds East a distance of 50.00 feet; THENCE S 50016'35"W departing said Ellis Avenue and along the southerly boundary of the alley to be vacated a distance of 231.12 feet to a point in the northerly line of an existing apparent street or alley; THENCE S 77035'30" W along the northerly line of said street or alley a distance of 14.96 feet to a point at the beginning of a curve to the left, having a radius of 293.00 feet; THENCE Southwesterly along the arc of said curve to the left an arc distance of 64.73 feet, through a central angle of 12 degrees 39 minutes 26 seconds, with a chord bearing of S 71015'45" W and a chord distance of 64.60 feet to a point for corner in the northerly boundary of the alley to be vacated; THENCE N 50016'35" E departing said apparent existing street or alley and along said northerly boundary of the alley to be vacated a distance of 304.75 feet to a point in the southwest right-of-way line of said Ellis Avenue; THENCE S 39040'25" E along the southwest right-of-way line of said Ellis Avenue a distance of 30.00' to the POINT OF BEGINNING and containing within the metes and bounds herein recited 7910 square feet or 0.182 acres of land, in all. A Survey Plat depicting a graphic image of this 30'Wide Alley styled as "EXHIBIT B" 30, WIDE ALLEY TO BE VACATED accompanies and is attached hereto and made a part thereof by this reference. Bearings shown herein are referenced to the Texas Coordinate System of 1983, North Central Zone, and are based on the North American Datum of 1983, CORS96 Adjustment. Adopt the attached ordinance vacating an alley between Ellis Avenue and Houston Street within Marine Park to the City of Fort Worth; and 2. Waive any and all purchase fee value of the vacated land in accordance with City Policy (M&C G- 15624). DISCUSSION: JEA-Hydrotech Engineering, Inc., on behalf of the City of Fort Worth, has requested the vacation of this alley to replat it with the adjoining property to incorporate it with Marine Park. The City Plan Commission recommended approval of this request at its meeting on September 26, 2012. An acceptable replat (FS- 012-110) has been received. The City of Fort Worth originally obtained the above mentioned right-of-way through the platting process. The City owns all the land adjacent to the above referenced alley as a part of Marine Park. Since the property is wholly contained within the boundary of a City park, collection of the fair market value or any portion thereof is recommended by Staff to be waived. This project is located in COUNCIL DISTRICT 2. FISCAL INFORMATION /CERTIFICATION: The Financial Management Services Director certifies that this action will have no material effect on City funds.
