AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF
MAIN STREET, LOCATED BETWEEN THIRD STREET AND FOURTH
STREETS AS SHOWN IN THE ORIGINAL TOWN OF FORT WORTH
ADDITION, AN ADDITION TO THE CITY OF FORT WORTH,
TARRANT COUNTY, TEXAS, AS FILED IN CABINET A, SLIDE 591 OF
THE PLAT RECORDS OF TARRANT COUNTY, TEXAS; CONTAINING
APPROXIMATELY 16,000 SQUARE FEET OF LAND; PROVIDING FOR
REVERSION OF FEE IN SAID LAND; THE RETAINMENT OF UTILITY
EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That a portion of Main Street, situated in the M. Baugh Survey, Abstract Number 106,
City of Fort Worth, Tarrant County Texas and being located between Third Street and Fourth
Street as shown on Original Town of Fort Worth, an addition to the City of Fort Worth, Tarrant
County, Texas as recorded in Volume Cabinet A, Slide 591 of the Plat Records of Tarrant
County, Texas; containing approximately 16,000 square feet of land more or less, and as more
specifically described in Exhibit "A" attached hereto and incorporated herein by reference be and
the same is vacated and extinguished.
SECTION 2.
That the fee to the land in the above-described vacated right-of-way is hereby released
and shall revert to the adjacent owner in accordance with the deed without warranty and as
provided by law.

SECTION 3.
That all utility easements shall be retained by the City.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION S.
That this ordinance shall take effect upon adoption.

BEING a 0.1837 acre tract of land situated In the M. Baugh Survey, Abstract Number 106, City of Fort Worth,
Torront County, Texas, being a portion of Main Street situated between Third Street and Fourth Street as
shown on Original Town of Fort Worth, on Addition to the City of Fort Worth according to the plat recorded
in Cabinet A, Slide 591, Plat Records of Torront County, Texas, said 0.1837 acre tract of land being more
particularly described as follows:
BEGINNING at a found 'X" cut in brick for the Intersection of the westerly right-of-way line of Main Street
(80 feet wide) and the northerly right-of-woy line of Fourth Street (60 feet wide),
THENCE North 30 degrees 26 minutes 44 seconds West, along the westerly right-of-way line of said Main
Street, a distance of 200.00 feet to a point for the intersection of the southerly right-of-way line of sold
Third Street and the westerly right-of--way line of said Main Street from which a found "X" cut in brick
bears North 33 degrees 05 minutes 42 seconds East, a distance of 3.02 feet from said corner;
THENCE North 59 degrees 33 minutes 16 seconds East, a distance of 40.00 feet to a point for corner;
THENCE South 30 degrees 26 minutes 44 seconds East, a distance of 200.00 feet to a point for corner;•

Adopt Ordinance Vacating the Portion of Main Street Between 3rd Street and 4th Street to the Adjacent
Property Owner, Sundance Square Partners, and Authorize the Execution of Conveyance Instruments
(COUNCIL DISTRICT 9)
RECOMMENDATION:
It is recommended that:
1. The City Council adopt the attached ordinance vacating the portion of Main Street between 3rd Street
and 4th Street to the adjacent property owner, Sundance Square Partners.
2. The City Council authorize the execution and recording of the appropriate instruments conveying the
property to complete the vacation of the street.
DISCUSSION:
Dunaway Associates, Inc., on behalf of Sundance Square Partners, has requested the vacation of this
portion of Main Street to replat it with the adjoining property for a new plaza development. The City Plan
Commission recommended approval of this request at its meeting on December 21, 2012. An acceptable
replat (FS-012-161) has been received.
The City of Fort Worth (City) originally obtained the above mentioned right-of-way through the platting
process. Upon approval of the vacation of the public right-of-way, a deed without warranty will be
executed to release all rights and interests, with the exception of the utility easements, in the public right-
of-way. No structures shall be allowed to be built in the retained easements. The applicant will pay
$400,000.00 in fair market value for the vacated public right-of-way.
The City will retain the right to have the street returned to the City if the property is not continuously used
as a plaza for entertainment and dining purposes.
This project is located in COUNCIL DISTRICT 9.
FISCAL INFORMATION / CERTIFICATION:
The Financial Management Services Director certifies that the Transportation and Public Works
Department Right-of-Way and Easements will be responsible for the collection and deposit of funds due to
the City.
