HomeMy WebLinkAboutOrdinance 25167-11-2021ORDINANCE NO. 25167-11-2021 AN ORDINANCE ADJUSTING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GENERAL GAS LEASE CAPITAL PROJECTS FUND IN THE AMOUNT OF $1,000,000.00, BY INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE OSACQ ROCK CREEK RANCH PROJECT (CITY PROJECT NO. 103624), AND DECREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE OPEN SPACE APPROPRIATIONS PROJECT (CITY PROJECT NO. PA0001) BY THE SAME AMOUNT; HEREBY AUTHORIZING THE USE OF OPEN SPACE FUNDS FOR THE PURPOSE OF CONSERVING 40 ACRES IN A NATURAL STATE AND POTENTIAL PASSIVE RECREATION, PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2020-2021 in the Budget of the City Manager, there shall also be adjusted estimated receipts and appropriations in the General Gas Lease Capital Projects Fund in the amount of $1,000,000.00, by increasing estimated receipts and appropriations in the OSAcq Rock Creek Ranch project (City Project No. 103624), and decreasing estimated receipts and appropriations in the Open Space Appropriations project (City project No. PA0001) by the same amount, hereby authorizing the use of Open Space funds for the purpose of conserving 40 acres in a natural state and potential passive recreation. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 24446-09-2020 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Gonzales Acting City Secretary ADOPTED AND EFFECTIVE: November 9.2021 City of Fort Worth, Texas Mayor and Council Communication DATE: 11/09/21 LOG NAME: 03CORRECTION AO SUBJECT M&C FILE NUMBER: M&C 21-0828 (CD 6) Repeal Appropriation Ordinance and Adopt Revised Appropriation Ordinance for Previously Approved Park Land Acquisition Project to Correct a Project Number and Project Name with No Change in Authorized Amount and Update the FY2021-2025 Capital Improvement Program RECOMMENDATION: It is recommended that the City Council: 1. Repeal Ordinance No. 25049-09-2021; 2. Adopt the attached appropriation ordinance adjusting estimated receipts and appropriations in the General Gas Lease Capital Projects Fund by increasing receipts and appropriations in the OSAcq Rock Creek Ranch project (City Project No. 103624) in the amount of $1,000,000.00 and decreasing receipts and appropriations in the Open Space Appropriations project (City Project No. PA0001) by the same amount, hereby authorizing the use of Open Space funds for the purpose of conserving 40 acres in a natural state and for potential passive recreation, which replaces Ordinance 25049-09-2021; and 3. Update the FY2021-2025 Capital Improvement Program. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to repeal and readopt an appropriation ordinance for a previously approved Park Land Acquisition project to correct a project number and name but keep all appropriated amounts the same. On September 14, 2021 Mayor and Council approved M&C 21-0672 214850 HIGHWAY 1187 authorizing the purchase of approximately 270 acres of land located at 4850 Highway 1187 in accordance with the Neighborhood and Community Park Dedication Policy and the Park, Recreation and Open Space Master Plan. The estimated total purchase price was $6,750,000.00 and the parkland is to be known as Rock Creek Ranch Park. The funding for the parkland purchase is a combination of 2018 Bond Program Funds, PARD Dedication Fees, and Open Space Funds in the amounts of $1,919,000.00, $3,901,000.00, and $1,000,000.00 respectively. A clerical error was made on M&C 21-0672 for the purchase of Rock Creek Ranch Park. In the recommendation, which appropriated the use of open space funds, an incorrect project ID was listed. In addition, a minor correction to the project name is needed. This M&C is seeking to correct the project ID, name, and associated ordinance. A separate project has been set up under the open space program to track and fund a 40-acre portion of the 270-acre dedicated parkland aquisition. All other recommendations, including their respective appropriation ordinances, were accurate and remain in effect as authorized through M&C 21-0672. In the previous M&C discussion it was also noted that funding was included in the FY2021-2025 Capital Improvement Program for project PA0001. This is being rescinded as originally stated and restated as the following: Open Space funding was not included in the FY2021-2025 Capital Improvement Program. Open Space will continue to be appropriated via M&C's as funding becomes available and each acquisition or use of funds is identified and requested for approval by Mayor and Council. The action on this M&C will update the FY2021-2025 Capital Improvement Program. Approval of this M&C will repeal the prior, incorrect appropriation ordinance and adopt a new one reflecting the same dollar amounts but with the correct project ID and name. This property is located in COUNCIL DISTRICT 6. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity.
