AN ORDINANCE ADJUSTING APPROPRIATIONS IN THE 2018 BOND
PROGRAM FUND IN THE AMOUNT OF S1,655,000.00 BY INCREASING
APPROPRIATIONS IN THE PUBLIC ART — STREETS MOBILITY
PROGRAMMABLE (CITY PROJECT NO. PB0008), AND DECREASING
APPROPRIATIONS IN THE AUTHORIZED, NOT APPROPRIATED PROJECT
(CITY PROJECT NO. U34018) BY THE SAME AMOUNT; PROVIDING FOR A
SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF
PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2021-2022 in the
Budget of the City Manager, there shall also be adjusted appropriations in the 2018 Bond Program Fund in
the amount of $1,655,000.00 by increasing appropriations in the Public Art— Streets Mobility Programmable
(City Project No. PB0008), and decreasing appropriations in the Authorized, Not Appropriated project (City
Project No. U34018).
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair
the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall
be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance 25073-09-2021 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Programmable Project and Adopt Attached Appropriation Ordinance Increasing Appropriations in the 2018 Bond Program Fund in the Amount of
$1,655,000.00 for the Public Art — Streets Mobility Programable Project
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached City of Fort Worth Public Art Annual Work Plan for Fiscal Year 2022;
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Specially Funded Projects Fund, in the
amount of $100,000.00 from available Funds, for the FWPA Collection Management programmable project (City Project P00056); and
3. Adopt the attached appropriation ordinance increasing appropriations in the 2018 Bond Program Fund, in the amount of $1,655,000.00,
from available funds for the Public Art — Streets Mobility Programable Project (City Project No. PB0008) subject to subsequent city council
authorization of an artwork commission contract for each public art project included in the annual work plan.
DISCUSSION:
Fort Worth's first iconic public art project premiered on August 20-21, 2021 in the form of new site -based audio visual artworks by internationally
renowned artists Refik Anadol and Quayola were projected on Pioneer Tower in the Will Rogers Memorial Center (CD 7) as part of a first -of -its -
kind event titled, New Stories: New Futures at Pioneer Tower, presented by the Arts Council of Fort Worth in partnership with AURORA. Other new
artworks added to the Fort Worth Public Art Collection during Fiscal Year 2021 were installed at the following locations: Chisholm Trail Park (CD
6); Golden Triangle Library (CD 7); Reby Cary Youth Library (CD 8); Westcreek Drive (CD 9); Rosedale Plaza Park (CD 5); Lake Como Park (CD
3); Hemphill Connector (CD 9); and, Rockwood Clubhouse (CD 2).
The Fort Worth Art Commission recommended the City of Fort Worth Public Art Annual Work Plan (Capital Improvement Plan) for Fiscal Year
2022 on August 16,2021, after holding public hearings on July 19, 2021 and August 16, 2021. The plan includes a total of 43 new and in -progress
public art projects with combined budgets totaling over $11 million, previously approved by City Council in funding source -specific public art plans,
as listed on the Annual Work Plan document. A presentation of the annual work plan was made at the City Council Work Session of September
14, 2021.
On September 28, 2021, City Council authorized a contract with the Arts Council of Fort Worth & Tarrant County, Inc. (Arts Council), to manage the
Fort Worth Public Art Program for Fiscal Year 2022, as well as provide other arts -related services. The City of Fort Worth Public Art Annual Work
Plan for Fiscal Year 2022, as adopted by City Council, will comprise the Arts Council's scope of work for the City's public art program.
Public art projects follow the guidelines contained in the City Council's adopted Fort Worth Public Art Master Plan Update, Mayor and Council
Communciation (M&C) G-19140, October 17, 2017. Individual City Council members are directly involved with project planning, artist selection,
and design review for public art projects in their districts. However, City Council, as a body, authorizes all Artwork Commission Contracts, through
separate M&Cs.
For projects included in the 2018 Bond Program, available resources within the General Fund will be used to provide interim financing until debt is
issued. Once debt associated with the project is sold, bond proceeds will reimburse the General Fund in accordance with the statement
expressing official Intent to Reimburse that was adopted as part of the ordinance canvassing the bond election (Ordinance No. 23209-05-2018)
and subsequent actions taken by the Mayor and Council.
Recommendation 2 of this M&C corrects an appropriation of $1,000,000.00, which City Council authorized on September 29, 2015 as M&C G-
18584, from the FY2015 Water and Sewer Operating Funds to the Specially Funded Capital Projects Fund for collection management and
conservation, which was erroneously deposited into the Specially Funded Capital Projects Fund for new public art projects.
These projects are located throughout ALL COUNCIL DISTRICTS.
A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that funds are currently available in the Unspecified -Public Art Enhan project within the Specially Funded Projects
Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinances, funds will be available in the
Specially Funded Projects Fund for the FWPA Collection Management programmable project and in the 2018 Bond Program Fund for the Public
Art -Streets -Mobility programmable project. Prior to an expenditure being incurred, the Planning and Data Analytics Department has the
responsibility of verifying the availability of funds.
