CAPITAL PROJECTS FUND IN THE AMOUNT OF $128,824 AND THE SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $51,142 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING AN ENGINEERING AGREEMENT WITH BAIRD, HAMPTON, & BROWN, INC. FOR WATER AND SANITARY SEWER REPLACEMENT CONTRACT 2005 WSM-l; PROVIDING FOR A SEVERAB[LITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1, That in addition to those amounts allocated to the various City departments for Fiscal Year 2x05-2006 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $128,824 and the Sewer Capita{ Projects Fund in the amount of $51,142 from available funds for the purpose of funding an engineering agreement with Baird, Hampton & Brown, Inc. for Wa#er and Sanitary Sewer Replacement Contract 2005 WSM-I. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inopera#ive or void far any reason by a court of competent jurisdiction, such decision, opinion nr judgment shall in nn way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 16582 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. It is recommended that the City Council: 1. Authorize the transfer of $179,966.00 from the Water & Sewer Operating Fund to the Water Capital Projects Fund in the amount of $128,824.DD and Sewer Capital Projects Fund in the amount of $51,142.DD; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriation in the Water Capital Projects Fund in the amount of $128,824.00 and the Sewer Capital Projects Fund in the amount of $51,142.00, from available funds; and 3. Authorize the City Manager to execute an Engineering Agreement with Baird, Hampton & Brown, lnc., in the amount of $151,836.00 far Water and Sanitary Sewer Replacement Contract, 2005 WSM-{. DISCUSSION: This project consists of the preparation of plans and specifications for water and sanitary sewer fine replacement as indicated on the following streets: Street From To Scope of Work Walton Avenue Woodway Lane Whitman Avenue waterlsewer Woodway Lane Walton Avenue Trait Lake Drive waterlsewer All disturbed segments of pavement will be permanently repaired with asphalt after the proposed improvements are complete. Baird, Hampton & Brown, Inc., proposes to perform the necessary design work fior a lump sum fee of $151,836.00 City staff considers this fee fio be fair and reasonable for the scope of services proposed. In addition to the contract amount, $28,070.00 (water. $22,550.00; and sewer: $5,520.00}, is required for project management by the Engineering Department. Baird, Hampton & Brown, lnc., is in compliance with the City's MIWBE Ordinance by cammifting to 23% MIWBE participation. The City's goof on the project is 22%. The project is located in COUNCIL.
