HomeMy WebLinkAboutOrdinance 20630-02-2013 Ordinance No. 20630-02-2013 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIALLY FUNDED CAPITAL PROJECT FUND IN THE AMOUNT OF $175,000.00, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING CONSTRUCTION RELATED EXPENSES FOR THE MAGNOLIA URBAN VILLAGE STREETSCAPE IMPROVEMENT PROJECT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1, That in addition to those amounts allocated to the various City departments for Fiscal Year 2012-2013 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Specially Funded Capital Project Fund in the amount of$175,000.00, from available funds, for the purpose of funding construction related expenses for the Magnolia Urban Village Streetscape Improvement Project. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No, 204 1 1-09-20 1 2 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize the execution of a contract with The Fain Group, Inc., in the amount of$1,227,222.50 for construction of pedestrian and streetscape improvements in the Magnolia Urban Village on Hemphill Street between Oleander Street and Allen Street; 2. Authorize the acceptance of a $175,000.00 contribution from the Southside Tax Increment Financing District No. 4, Southside TIF, for construction-related expenses; and 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Specially Funded Capital Project Fund in the amount of$175,000.00 for construction-related expenses for the Magnolia Urban Village Streetscape Improvement Project. DISCUSSION: This Mayor and Council Communication recommends award of contract for the construction of streetscape improvements along Hemphill Street. Improvements include: narrowing some portions of the roadway between West Oleander Street and Allen Street, constructing new sidewalks with paver accents, and installing pedestrian lighting, street trees and landscaping. On September 13, 2005, (M&C G-14914)the City Council authorized the City Manager to apply for and accept a federal transportation grant for pedestrian and streetscape improvements in the Magnolia Urban Village. The City was awarded a grant in the amount of$1,233,688.00 from the Federal Congestion Mitigation and Air Quality Improvement Program (CMAQ)for pedestrian and streetscape improvements in the Magnolia Urban Village and $308,422.00 from the Southside TIF as the 20 percent local match required by the North Central Texas Council of Governments (NCTCOG) Land Use/Transportation Joint Venture Program. During the design of the project, Fort Worth South, Inc., requested that the project limits be extended to Allen Street (from the original boundary of Morphy Street) and the Southside TIF provided an additional $175,000.00 for this purpose. Funding Allocations Streetscape Construction $1,227,222.50 Inspection, Survey, Material Testing, etc. $145,306.15 Construction Management $42,511.00 10 Percent Contingency $122,722.25 Total $1,495,250.90 The Parks and Community Services Department has estimated that the annual budget impact for maintenance of this project could average $5,400.00 per 0.1 mile (approximately one block). The project limits span 0.4 mile. Contractor Selection and MfWBE Compliance The Project was advertised on September 27, 2012 and October 4, 2012, in the Fort Worth Star- Telegram, La Vida News: The Black Voice and the Commercial Recorder in compliance with TxDOT requirements. The City's DBE goal on this project is 18 percent. This project is located in COUNCIL DISTRICT 9. FISCAL INFORMATION / CERTIFICATION: The Financial Management Services Director certifies that upon approval of the above recommendations, and adoption of the attached appropriation ordinance, funds will be available in the current capital budgets, as appropriated, of the Grants Fund and the Specially Funded Capital Project Fund.
