Home My WebLink AboutResolution 5509-11-2021 A Resolution NO. 5509-11-2021 APPOINTING CERTAIN PERSONS TO THE BOARD OF DIRECTORS FOR EACH OF THE CITY'S TAX INCREMENT REINVESTMENT ZONES AND APPOINTING A CHAIRPERSON FOR EACH OF THE BOARD OF DIRECTORS WHEREAS, the City Council of the City of Fort Worth ("City Council" and "City", respectively) previously created the following Tax Increment Reinvestment Zones ("TIF(s)") via the respective ordinances referenced below ("Creation Ordinance(s)"): a. Tax Increment Reinvestment Zone Two (Ordinance No. 12323) b. Tax Increment Reinvestment Zone Three (Ordinance No. 12324) c. Tax Increment Reinvestment Zone Four (Ordinance No. 13259) d. Tax Increment Reinvestment Zone Six (Ordinance No. 15325) e. Tax Increment Reinvestment Zone Eight (Ordinance No. 15775) f. Tax Increment Reinvestment Zone Nine (Ordinance No. 15797) g. Tax Increment Reinvestment Zone Ten (Ordinance No. 16002) h. Tax Increment Reinvestment Zone Twelve (Ordinance No. 17061-07-2006) i. Tax Increment Reinvestment Zone Thirteen (Ordinance No. 17889-11-2007) j. Tax Increment Reinvestment Zone Fourteen (Ordinance No. 20505-11-2012) k. Tax Increment Reinvestment Zone Fifteen (Ordinance No.21550-12-2014); WHEREAS,each Creation Ordinance provides that each of the TIFs are governed by a Board of Directors ("Board"), which may include appointments by the City Council and other participating taxing entities; WHEREAS, House Bill 2853, which was passed by the 82nd Texas Legislature and took effect on June 17,2011, amended Texas Tax Code Section 311.009 regarding appointment of Board members of tax increment reinvestment zones and prevails over any conflicting provision of Creation Ordinances dated prior to June 17, 2011; WHEREAS,the term for certain Board members of each respective TIF expires on December 31, 2021, and the City Council wishes to make appointments to those places for terms beginning January 1, 2022 and expiring December 31, 2023; WHEREAS, the Board members subject to appointment by the City Council are set forth in Exhibit A and labeled as "Appointee"; WHEREAS, the existing Board members of each respective TIF, including those appointed by the City Council and other participating taxing entities, are also set forth in Exhibit A and labeled as "existing member"; WHEREAS, Texas Tax Code Section 311.009(c) provides that Board members will be appointed for a term of two (2) years unless otherwise indicated; WHEREAS, the City Council has the right, at any time and for any reason, to appoint an individual to the Board to replace any current member appointed by the City Council for the remainder of that person's term; and WHEREAS, Texas Tax Code Section 311.009(t) provides that the City Council must appoint one (1) member of the Board to serve as the Board's chairperson for a term of one (1) year beginning January 1, 2022. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS,THAT: 1. Except as set forth in Section 2 below,the City Council appoints each person identified in Exhibit A as "Appointee"to represent the City on the Board of each respective TIF for terms beginning January 1, 2022 and expiring December 31, 2023. 2. The City Council also appoints Kathleen Culebro to the Board for TIF No.4 to serve the remainder of Carlo Capua's term, and Casey Lane to the Board for TIF No. 14 to serve the remainder of Ryan Martin's term, both of which expire on December 31, 2022. 3. The City Council appoints the persons designated as chairperson in Exhibit A for each respective TIF to serve as chairperson for a term beginning January 1, 2022 and expiring December 31, 2022. 4. The City Council reserves the right, at any time and for any reason,to remove a Board member or chairperson appointed by the City Council and to appoint individuals to the Board or as chairpersons to replace any of the City Council appointed Board members or chairpersons.
