HomeMy WebLinkAboutOrdinance 25204-11-2021 ORDINANCE NO. 25204-11-2021 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE INTERGOVERNMENTAL CONTRIBUTION FUND IN THE AMOUNT OF $1,499,303.60, FOR THE PURPOSE OF FUNDING THE KELLER HICKS IMPROVEMENTS PHASE 1 LAUREN WAY TO KATY ROAD PROJECT (CITY PROJECT NO. 100146); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2021-2022 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Intergovernmental Contribution Fund in the amount of $1,499,303.60, for the purpose of funding the KellerHicks Improvements Phase 1 Lauren Way to Katy Road project(City Project No. 100146). SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shallbe and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 25073-09-2021 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations,in which instance said conflicting provisions ofsaid prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize execution of an Interlocal Agreement with the City of Keller in the amount of$1,499,303.60 with no cost to City of Fort Worth for Improvements within the City of Keller from Katy Road to US Highway 377 as part of the Keller Hicks Road Improvements project from Lauren Way to Katy Road(City Project No. 100146); 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Intergovernmental Contribution Fund, in the amount of$1,499,303.60,for the purpose of funding the Keller Hicks Improvements Phase 1 Lauren Way to Katy Road project(City Project No. 100146);and 3. Amend the Fiscal Years 2022-2026 Capital Improvement Program, DISCUSSION: Keller Hicks Phase 2,from Katy Road to US Highway 377(US 377),is the continuation of Phase 1 and will include a 2-lane concrete road, left-turn lanes in all directions at the Keller Hicks Road and Katy Road intersection(Katy Road is also the city limits line between Fort Worth and Keller),a quiet zone railroad crossing,sidewalk railroad crossings and traffic signal improvements at Keller Hicks Road and US 377. The City of Fort Worth and City of Keller have agreed to a 50%split of the new traffic signal at Keller Hicks and Katy Road. Keller Hicks Phase 1,completely within the City of Fort Worth city limits,is approximately 2,000 feet in length and is identified in the City's Master Thoroughfare Plan as a 3-lane commercial connector.The project will replace the existing 2-lane asphalt road with a 3-lane concrete street with a travel lane in each direction, including a mutual left-turn lane,drainage,street lights,ten-foot sidewalks and American with Disabilities Act (ADA)facilities. The ultimate construction of Keller Hicks Road is a joint project between the City of Fort Worth,the City of Keller,and the adjacent developer, D. R.Horton. Construction of this Keller Hicks Phase 2 Project is anticipated to begin in Spring 2022. Funding for the overall project is being provided from Transportation Impact Fees approved by Mayor and Council Communication(M&C)20-0623&C-27715 and the 2018 Bond Program. Available resources within the General Fund will be used to provide interim financing until debt is issued. Once debt associated with the project is sold, bond proceeds will reimburse the General Fund in accordance with the statement expressing official Intent to Reimburse that was adopted as part of the ordinance canvassing the bond election(Ordinance No. 23209-05-2018)and subsequent actions taken by the Mayor and Council. Funding for this project was not included in the FY2022-2026 Capital Improvement Program due to just recently entering into an interlocal agreement with the City of Keller to cost share expenses. The action in this M&C will amend the FY2022-2026 Capital Improvement Program as approved in connection with Ordinance 25073-09-2021. The Project is located in COUNCIL DISTRICT 7. A Form 1295 is not required because:This contract will be with a governmental entity,state agency or public institution of higher education:City of Keller FISCAL_INFORMATION/CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations,execution of the interlocal agreement and adoption of the attached appropriation ordinance,funds will be deposited into the Intergovernmental Contribution Fund for the Keller Hicks Rd. Phase 2(US 377 to Katy Rd.)project. The Transportation&Public Works Department(and Financial Management Services)is responsible for the collection and deposit of funds due to the City.Prior to any expense being incurred,the Transportation&Public Works Department also has the responsibility to validate the availability of funds.
