HomeMy WebLinkAboutOrdinance 20603-02-2013 ORDINANCE NO. 20603-02-2013 AN ORDINANCE ORDERING A GENERAL ELECTION BY THE QUALIFIED VOTERS OF THE CITY OF FORT WORTH, TEXAS, ON SATURDAY, THE 11TH DAY OF MAY, 2013, FOR THE PURPOSE OF ELECTING THE MAYOR AND COUNCIL MEMBERS FOR THE CITY OF FORT WORTH AND PROVIDING A RUNOFF DATE, IF NEEDED. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: SECTION 1. ELECTION ORDERED. In compliance with the Charter of the City of Fort Worth and in accordance with the Constitution and laws of the State of Texas, the City Council hereby orders that an election be held on Saturday, May 11, 2013, as authorized by Section 41.001 of the Texas Election Code, at which all qualified voters may vote for the purpose of electing a Mayor at large and eight (8) Council Members of Council Districts 2, 3, 4, 5, 6, 7, 8 and 9, respectively. SECTION 2. CANDIDATES. Candidates may file an application for a place on the election ballot commencing January 30, 2013, in the City Secretary's Office, located in the Municipal Building, 1000 Throckmorton Street, Fort Worth, Texas. The filing deadline is 5:00 p.m., March 1, 2013. SECTION 3. BALLOT. The City Secretary of said City shall ensure that ballots are prepared to be used in said election, on which ballots shall be printed the names of the candidates for the at-large position of Mayor and the names of the candidates from the respective single member districts for the position of Council Member. The places of the different candidates shall be designated on the official ballot as Mayor and Member of Council Districts 2, 3, 4, 5, 6, 7, 8, and 9, respectively. The ballots shall be printed in English and in Spanish for use in said election. SECTION 4. DRAWING FOR PLACES ON THE BALLOT. In the event that there are two (2) or more candidates for the office of Mayor or two (2) or more candidates from the same single member district for membership on the City Council, the order in which the names of such candidates are to be printed on the ballot shall be determined by a drawing to be conducted by the City Secretary. Three (3) days prior to the date on which the drawing is to be held, the City Secretary shall post a notice in the City Hall of the time and place of the drawing and shall also give personal notice to any candidate who makes written request therefor and furnishes to the City Secretary a self-addressed stamped envelope; and that each candidate involved in the drawing or a representative designated by him or her shall have a right to be present and observe the drawing. SECTION 5. EARLY VOTING CLERKS. (a) Steve Raborn, Tarrant County Elections Administrator, shall serve as the early voting clerk for the Tarrant County portion of the election. Kayser, City Secretary of the City of Fort Worth, shall serve as chief deputy early voting clerk. (e) Applications for ballots by mail shall be mailed to Steve Rabom for Tarrant County, Frank Phillips for Denton County, and Robert Parten for Parker County at the addresses set out in subsections (a), (b) and (c) above. Applications for ballot by mail must be received no later than the close of business on May 3, 2013. SECTION 6. EARLY VOTING. (a) Early Voting by personal appearance of Fort Worth residents shall be conducted beginning April 29, 2013, and continue through May 7, 2013. The City Secretary may change the places and/or times contained in Exhibits A-1, A-2 and A-3 without further City Council action or approval after consulting with the Tarrant County Elections Administrator, the Denton County Elections Administrator, and/or the Parker County Elections Administrator and determining that a change in place and/or time is necessary. SECTION 7. VOTING SYSTEM. (a) An electronic voting system, as defined in Chapter 121 of the Texas Election Code, shall, be used for voting at the regular polling places for said election and for counting the ballots and the tabulation of the results. The conduct of the election and the use of the electronic voting system shall be in accordance with the Texas Election Code. (b) (1) The Office of the Tarrant County Elections Administrator, 2700 Premier Street, Fort Worth, Texas, is established as the Central Counting Station for the ballots cast in Tarrant County in said election; (2) The Office of the Denton County Elections Administrator, 701 Kimberly Drive, Denton, Texas, is established as the Central Counting Station for the ballots cast in Denton County in said election-, and Ordinance Ordering May 11,2013 Ordinance No. 20603-02-2013 General Election Page 4 of 7 (3) The Office of the Parker County Elections Administrator, 1112 Santa Fe Dr., Annex Kitchen, Weatherford, Texas, is established as the Central Counting Station for the ballots cast in Parker County in said election. (c) Each of the above-named Central Counting Stations shall appoint all individual, having knowledge and experience in the conduct of elections with the electronic voting system for which each Central Counting Station is established, as Manager of the respective Central Counting Station. The Manager shall be in charge of overall administration of the individual county's Central Counting Station and the general supervision of the personnel working at the Station, (d) Each of the counties named in sub-section (b) above shall appoint all individual trained in the operation of the automatic tabulating equipment as Tabulation Supervisor. The Tabulation Supervisor shall be in charge of the operation of the automatic tabulating equipment in the respective county. (e) Each of the Counties named in sub-section (b) above shall appoint an individual as Assistant to the Tabulation Supervisor, Such assistant shall assist the Tabulation Supervisor in the operation of the automatic tabulating equipment as directed by the Tabulation Supervisor. (f) Each of the counties named in sub-section (b) above shall appoint an individual as Presiding Judge of the Central Counting Station. The Presiding Judge shall maintain order at the Central Counting Station and shall have such authority as may be prescribed by the Texas Election Code. (g) The Tarrant, Denton, and Parker County polling places shall be kept open on May 11, 2013, from 7:00 a.m. to 7:00 p.m., and due returns shall be made to the City Council showing the number of votes cast for the office of Mayor and for membership on the Fort Worth City Council. (h) The locations of the polling places for the election, contained in Exhibit B-1, Tarrant County Election Day Polling Locations, Exhibit B-2, Denton County Election Day Polling Locations, and Exhibit B-3, Parker County Election Day Polling Locations, each attached hereto for reference. The City Secretary may change the places and/or times contained in Exhibits B-1, B-2 and B-3 without further City Council action or approval after consulting with the Tarrant County Elections Administrator, the Denton County Ordinance Ordering May 11,2013 Ordinance No.20603-02-2013 General Election Page 5 of 7 Elections Administrator, and/or the Parker County Elections Administrator and determining that a change in place and/or time is necessary. SECTION 8. RUNOFF. Any candidate receiving a majority of all the votes cast for the office for which he or she is a candidate shall be elected to Such office. In the event of a tie or in the event that no candidate receives a majority of all votes cast for the office sought, the Mayor shall issue a call, proclamation and notice for a second election, as required by law, to be held on June 15, 2013, to fill that place. At such second election, the names of the two candidates receiving the highest number of votes for any such office or offices, as the case may be, in the first election at which no one was elected by receiving a majority of all votes cast for such office or offices, shall be printed on the ballot and shall again be voted for. SECTION 9. PROCLAMATION. This ordinance shall constitute the proclamation, call, notice and ordinance calling and ordering said elections. SECTION 10. PUBLICATION. Notice of said elections shall be given by publishing a Notice of Election, in English and in Spanish, at least once, not earlier than the 301h day nor later than the 10`" day before election day in a newspaper published in said City. A copy of this ordinance, in English and in Spanish, shall be posted on the City's board used for posting notices of the meeting of the Fort Worth City Council not later than the 21" day before election day. SECTION IL NOTICE. The way and manner of holding said elections, the notice to be given therefor, the polling places, the personnel and the officers who are to hold same, and all details connected with the holding of the elections shall be arranged by the City Secretary, that the proper notice and Ordinance Ordering May 11,2013 Ordinance No. 20603-02-2013 General Election Page 6 of 7 publication of this notice, proclamation, call and ordinance shall be only cumulative of and in addition to the statutory notice of said elections as herein provided; and that any omission or irregularity in this notice or in the publication or posting of this notice, proclamation and ordinance, or in the signing of same, shall not in any way affect or invalidate such election. SECTION 12. CONTROLLING LAW. In all respects, said elections shall be conducted in accordance with the Texas Election Code and the City Charter of the City of Fort Worth. SECTION 13. OPEN MEETING COMPLIANCE. It is hereby officially found and determined that the meeting at which this ordinance was adopted and said elections were called was open to the public and public notice of the time, place and purpose of said meeting was given, all as required by Chapter 551 of the Texas Government Code. SECTION 14. EFFECTIVE DATE.
