HomeMy WebLinkAboutContract 56141-A1 Date Received: Dec 3,2021 City Secretary Time Received: 2:44 pm Number: 56141-A1 FIRST AMENDMENT TO CITY SECRETARY CONTRACT NO. 56141 EASEMENT ENCROACHMENT LICENSE AGREEMENT This FIRST AMENDMENT TO CITY SECRETARY CONTRACT NO.56141,EASEMENT ENCROACHMENT LICENSE AGREEMENT is made and entered into by and between the CITY OF FORT WORTH, a home rule municipal corporation of Tarrant County, Texas ("City"), acting herein by and through its duly authorized City Manager, Assistant City Manager, or Development Services Department Director, and QT South, LLC. a(n) corporation("Licensee"), acting herein by and through its duly authorized Director of Real Estate. RECITALS WHEREAS, City and Licensee made and entered into that certain Easement Encroachment Agreement identified as City Secretary Contract No. 56141 on August 10, 2021 (the "Agreement"), to authorize the Licensee's use of the City's storm drain easement(the "City Easement") for the purposes of installing sewer and water lines and a monument sign within the City Easement; and WHEREAS,the patties now wish to amend the Agreement to include the attached"Exhibit A-1" to add an additional 164 linear feet of retaining wall encroaching into the City Easement. NOW, THEREFORE, City and Licensee, acting herein by and through their duly authorized representatives, enter into the following that amends the Agreement: 1. "Exhibit A-]" is hereby attached hereto and incorporated herein to the Agreement,consisting of an additional description of the encroaching improvements. 2. The effective date of this Amendment shall be the date of its execution by the City. 3.
