I6956-05-2006 TO CORRECT UTILITIES CODE CITATIONS; PROVIDING THAT THIS ORDINANCE IS CUMULATIVE; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Utilities Code citations contained in Paragraphs 1 and 2 of Section 1 of Ordinance No. 16956-05-2006, in order of appearance, read 54.202, 37.059, and 181.046; but should read 54.203, 37.101, and 1 &1.047 respectively; and NOW, THEREFORE, I3E IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: Section 1. Section 1 of Ordinance No. 16956-05-2006 is amended to be and read: Pursuant to Section 54.203 of the Utilities Code, the City Council hereby requires that certificated telecoznmunicationsutilitics, Verizon atad One Source Conr~unications, relocate their respective facilities located in City right-of way in or along Keller-Hicks Road, at the utility's sole cost and expense, to an area within the new location{s} presented on Exhibit "A". Pursuant to Section 37.101 and/or Section 181.047 of the Utilities Code, the City Council hereby requires that electric utilities, TXU Electric Delivery and Tri-County Electric Cooperative,lnc., relocate iherr respective facilities located in City right-of way in or along Keller-Hicks Road, at the utility's sole cost and expense, to an area within the new location{s) presented on Exhibit "A". Pursuant to Sectian 3 of City Ordinance No. 10692, the City Council hereby requires that Atrraos Energy relocate its facilities located in City right- of way in or along Keller-Hicks Raad, at the utility's sole cost and expense, to an area within the new lacation(s} presented on Exhibit "A". Section 2. This Ordinance shall be cumulative of all provisions of ordinances anal of the Code of the City of Fort Worth, Texas (1.986}, as amended, except where the provisions of this Ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event canflicting provisions of such ordinances and such Cade are hereby repealed. Section 3. That if any portion, section or part of a section of this Ordinance is subsequently declared invalid, inoperative or void for any reason by a court of competent jurisdiction, the remaining portions, sections ar parts of sections of this Ordinance shall be and remain in full farce and effect and shall not in any way be impaired or affected by such decision, opinion or judgment.
