HomeMy WebLinkAboutOrdinance 16964-05-2006ORDINANCE NO. 1b964-05-2006 AN ORDINANCE AMENDING ORDINANCE NO. 1b894 TO REFLECT THE LOT AND BLOCK INFORMATION FOR ZONING CASE ZC-Ob-030, ZC-Ob-031, 7C-06-043, ZC-06-047, ZC- Ob-060; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABILITY CLAUSE AND NAMING AN EFFECTIVE DATE WHEREAS, on April 11, 2006, the City Council approved. a request in Case No. ZG06-030 to rezone property at 1158 Evans Avenue, from "F" General Commercial to iiMUl" Low Intensity Mixed Use, ZC-06-031 located. at 2713 Canberra Court, from "B" Two-Family Residential to "A-5" One-Family Residential, ZC-06-043 located at SS29 Van Natta Lane, from "B" Two-Family Residential to "A-5" One-Family Residential, ZC-O6-047 located at 30$ S. Adams Street, from "FR" General Commercial Restricted to "MU-2" High Intensity Mixed Use, ZC-06-060 located at 3302 Bright Street, from "B" Two-Family Residential to "A-5" One-Family Residential; WHEREAS, the City Council voted to approve the above mentioned cases, but Ordinance No. 16894 incorporatixag the City Council's zoning decisions from the April 1 l., 2006, meeting does not reflect the correct the lot and block information; WHEREAS, it is advisable to amend Ordinance No. 16894 with regard to Case No. ZC-OG-030, ZC--06-031, ZC-O6-043, ZC-O6-047, ZC-OG-060 only, in order to reflect the correct lot and block information; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH: SECTION 1. This ordinance corrects Qrdinance No. 16894 with regard to Case No. ZC--06-030, ZC-06-431, ZC-06--043, ZC-Ob-047, ZC-06-060 only. SECTlrO1~ 3. The zoning regulations and districts, as herein established, have been made in accordance with the comprehensive plan. far the purpose of promoting the health, safety, morals and general welfare of the community. They have been designed to lessen congestion in the streets; to secure safety from fire, panic, flood and other dangers; to provide adequate light and air; to prevent overcrowding of land; to avoid undue concentration of population; to facilitate the adequate provisions of transportation, water, sewerage, parks and other public requirements. They have been made after full and complete public hearing with reasonable consideration, among other things, of the character of the district and its peculiar suitability for the particular uses and with a view 3 of conservi~ag the value of a building and encouraging the most appropriate use of land thraughaut the community. SECTION 4. This ordinance shall be cumulative of all other ordinances of the City of Fort Worth affecting zoning and shall not repeal any of the provisians of such ordinances, except in those instances where provisions of such ordinances are in direct conflict with the pravisio~as of this ordinance. SECTION 5. All rights ar remedies of the City of Fort Worth, Texas,- are expressly saved as to any and all violations of Qrdinance N~o. 13896 or of any amendments thereto that have accrued at the time of the effective date of this ordinance; and as to such accrued violatians, and all pending litigation, both civil or criminal, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts. SEC'1CI®N G. It is hereby declared to be the intension of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared void, ineffective ar unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such voidness, ineffectiveness ar unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this ordinance, since the same would have been cnacted by the City Council without the incorporation herein of any such void, ineffective or unconstitutional phrase, clause, sentence, paragraph or section. SECTI®N 7. Any person, firm or corporation who violates, disobeys, amity, neglects or refuses to comply with or who resists the enforcement of any ofthe provisions of this ordinance shall be fined not more than Two Thousand Dollars ($2000.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. SECTI®I~I S. This ordinance shall take effect upon adoption and puYilicatian as required by law. However, Ordinance 16894 refilects incorrect lot and block information. The a##ached Ordinance correctly reflects the Council's decision and corrects a publishing error.
