March 16, 2021 Associate Administrator for Safety Federal Railroad Administration Office of Safety, RRS-23 1120 Vermont Ave., NW Washington, DC 20590 Subject: Public Authority Application to the FRA under 49 CFR 222.39 (b) for Proposed Quiet Zone: Union Pacific Railroad (UPRR) Timberland Blvd, Fort Worth, TX. The City of Fort Worth issued an NOI for the above referenced quiet zone on May 7, 2020. The City of Fort Worth, Texas requests the Associate Administrator of the FRA to approve this quiet zone under the public authority application method covered by 49 CFR 222.39(b). The City of Fort Worth provides the following required information in compliance with Section 222.39 (b)(1): Accurate, complete and current Grade Crossing Inventory Forms (Attachment B). These forms reflect the crossings as of March 8, 2021. The proposed safety measures this grade crossing include those items noted below. The following elements and devices are proposed for each crossing: This public grade crossing in the corridor will receive some type of safety improvement. ➢ Timberland Blvd - Alterative Safety Measure (ASM), non -traversable concrete medians • The city, railroad, or its contractors will install warning signs and the crossing will be in compliance with TxMUTCD Section 8B - Signs and Markings when the quiet zone is implemented. • When the quiet zone is placed into service, the city will install the required NO TRAIN HORN signs. iii. Diagnostic Team review. A Diagnostic Team Meeting was conducted on March 9, 2021 (See Attachment C). iv. The City of Fort Worth met with the railroad during the diagnostic meeting on site and the railroad personnel had no objections to the quiet zone at this location. (See Attachment C). The City received only one comment from NOI recipients and that was a "No Comment" from the City of Keller. (See Attachment E). TRANSPORTATION AND PUBLIC WORKS DEPARTMENT City of Fort Worth • 200 Texas Street • Fort Worth, Texas 76102 FORTWORTH. v. Detailed information on safety improvements implemented at each crossing. The City of Fort Worth plans to implement safety improvements at this public grade crossing in the quiet zone. The proposed non traversable concrete median lengths at Timberland Blvd public crossings will not qualify as a SSM and therefore, the city proposes establishment of the quiet zone using modified SSM which will be treated as Alternative Safety Measures (ASMs) per 49 CFR Appendix B Part 222 1 (A) (1). (See Attachment D for detailed calculations.) The proposed safety improvements at each crossing are as follows: Timberland Road is an existing five -lane highway equipped with flashing lights and gates, constant warning circuitry and power -out indicators. The existing traffic signal is interconnected with the railroad equipment and provides advance preemption. The city has installed non -traversable concrete medians that measure over 200 feet west of the crossing and approximately 50 feet east of the crossing. This modified SSM will be treated as an ASM in the establishment of the quiet zone. vi. Commitment to implement. All safety improvements presented in this letter will exist at each crossing when the quiet zone is implemented. vii. Demonstrate with data the proposed measures will be below the RIWH. The QZRI shown in Attachment D indicates that the existing Risk Index with Horns for this corridor is 31785.34. The calculation to determine the effectiveness rate for each location is shown in Attachment D and results in a QZRI is 13113.45. Therefore, the QZRI is lower than the RIWH, and this crossing qualifies as a quiet zone. See Attachment D for the RIWH calculation sheet and effective rate calculations. ACTION REQUIRED: Please consider this Public Authority Application and respond as appropriate to approve this quiet zone under the public authority application method covered by 49 CFR 222.39(b). The median on west side of crossing is over 200' in length and the median to the east of the crossing is approximately 50' in length due to a parallel highway. As a result, we are requesting permission to use a Modified SSM that will be treated as an Alternate Safety Measure (ASM) with an effective rate of 0.73 of the SSM (0.80). This crossing is also connected to the traffic signal to provide advanced preemption for additional safety for motorist. Credit for Pre -Existing Modified SSM in a Quiet Zone (See Appendix B to Part 222 1.13, Page 47650) ASM EFFECTIVE RATE ASSUMPTIONS: The east side is 50 feet divided by 60 feet requirement which is 83.33% of the required median length. The west side is over 100 feet which is 100% of required median length. Therefore, the east side is 83.33% divided by 2 equals 41.67 of total and the west side is 100% divided by 2 equals 50% of total. Therefore, 41.67% plus 50% equals 91.66% of required median length at this crossing. It is proposed to use 91.66 % of the effective rate for median barriers which is 0.8 times 0.9166 and the ASM effective rate is equal to 0.73. ASM Effective Rate 0.73 (Equal to 0.9166 times 0.80 SSM Effective Rate) (See Appendix B to Part 222, Page 47649, I. This letter and the attachments are a Notice of Intent for the creation of a quiet zone under 49 CFR 222.39(b)(1) and Appendix B to Part 222 (1). As required by the Federal Railroad Administration under 49CFR 222.43, the following information is provided to you and other parties. The public highway -rail grade crossing to be included within the proposed quiet zone are: Crossing ID Street Name Location on Street Improvements 795350M Timberland Boulevard 12600 Block Median Barrier The quiet zone is proposed to restrict the routine sounding of locomotive horns 24 hours a day. The City of Fort Worth plans to implement a quiet zone at this crossing with the proposed improvements described for the crossing below. Timberland Boulevard. —Alternate Safety Measure (ASM) Timberland Boulevard is an existing seven -lane divided highway with concrete non -traversable medians. The crossing Is equipped with flashing lights and gates, constant warning circuitry, and power -out indicators. There is an existing traffic signal located at Timberland Boulevard and US Highway 377 that is Interconnected with the railroad equipment to provide advance preemption operation. Although there are concrete non -mountable medians at this location, they do not comply with the length requirements to be considered as a Supplemental Safety Measure (SSM). The median on the west side of the crossing is over 200 feet in length and the median to the east of the crossing is approximately 50 feet in length due to a parallel highway. The median height is 8" which exceed the requirement for non -mountable curb. As a result, this modified SSM will be treated as an ASM in establishment of the quiet zone.
