HomeMy WebLinkAbout(0036) M&C 21-0824City of Fort Worth, Texas Mayor and Council Communication DATE: 10/19/21 M&C FILE NUMBER: M&C 21-0824 LOG NAME: 55DART SILVER LINE EASEMENT TO DFW TERMINAL B STATION SUBJECT (ALL) Authorize the Conveyance of a Public Mass Transit Easement on Property Located at Dallas Fort -Worth International Airport to the Dallas Area Rapid Transit Authority for Eleven Parcels of Land Which are Necessary to Accommodate the Dallas Area Rapid Transit Silver Line into the Terminal B Station RECOMMENDATION: It is recommended that the City Council: 1. Authorize the conveyance of a Public Mass Transit Easement on property located at Dallas -Fort Worth International Airport to the Dallas Area Rapid Transit Authority for Eleven Parcels of Land which are necessary to accommodate the Dallas Area Rapid Transit Silver Line into the Terminal B Station; and 2. Authorize the City Manager or his designee to execute and record the appropriate instruments. DISCUSSION: The Dallas Area Rapid Transit Authority (DART) is bringing its Silver Line from Plano, along the Cotton Belt Rail Line, to the Terminal B station at Dallas -Fort Worth International Airport (Airport). It will share the Fort Worth Transportation Authority (Trinity Metro) Easement from the Cotton Belt Rail Line to Terminal B. Because the two rail lines will exist and operate within close proximity, the two transit authorities have agreed to share easement areas which will be reflected in a joint amendment to DART and Trinity Metro's operating agreements with the Dallas -Fort Worth International Airport Board (Airport Board). However, both the Cotton Belt right-of-way and the Trinity Metro right-of-way need to be widened at 11 places to accommodate the new facilities, as shown in the attached map. DART will pay $3,776,446.00 in compensation to the Airport via a separate Compensation Agreement. This Mayor and Council Communication (M&C) authorizes the City of Fort Worth (City) to convey the necessary easement rights to DART for the development and maintenance of the public mass transit improvements, including rail and other facilities as discussed above. The Airport Board approved and authorized an agreement with DART for the permanent easement rights on August 5, 2021, via Official Board Resolution No. 2021-08-156. Both state law and the 1968 Contract and Agreement between the City of Dallas, Texas and the City of Fort Worth, Texas require that all real property transactions must be approved by the City Council of both cities. The Dallas City Council is expected to approve this transaction on October 13, 2021. This M&C does not request approval of a contract with a business entity.
