RATIFYING THE EMPLOYMENT OF THE LAW FIRM OF LLOYD
GOSSELINK ROCHELLE & TOWNSEND, PC AS OUTSIDE LEGAL COUNSEL
TO PROVIDE LEGAL REPRESENTATION TO THE CITY OF FORT WORTH
FOR ITS TEXAS COMMISSION ON ENVIRONMENTAL QUALITY
DISCHARGE PERMIT WQ0015668001 KNOWN AS DOCKET NO. 2021-1211-
MWD AND AUTHORIZING PAYMENT IN AN AMOUNT NOT TO EXCEED
$600,000.00
WHEREAS, on March 16, 2020, the Texas Commission on Environmental Quality (TCEQ)
issued draft permit WQ0015668001 to the City to allow for treated wastewater discharge at Mary's
Creek; and
WHEREAS, following the required notice published on April 3, 2020 and the public comment
period, the TCEQ conducted a public meeting on October 5, 2020; and
WHEREAS, several requests for reconsideration by the TCEQ and requests for a contested case
hearing were filed, including a request made by the Tarrant Regional Water District; and
WHEREAS, the TCEQ Executive Director, after consideration of written and oral public
comments, issued a written opinion that draft permit WQ0015668001, as issued, met the standards to be
protective of water quality and the uses of the receiving water and no changes were made to the draft
permit; and
WHEREAS, despite the TCEQ Executive Director's findings, the TCEQ granted a
reconsideration of the draft permit by the TCEQ Commissioners at a meeting set for November 3, 2021;
and
WHEREAS, the law firm of Lloyd Gosselink Rochelle & Townsend, PC possesses the required
knowledge and expertise to assist the City in this matter.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS, THAT:
1. The City ratifies the employment of the law firm of Lloyd Gosselink Rochelle &
Townsend, PC as outside counsel under Chapter VI, § 3 of the City Charter, for legal
services related to the TCEQ permit application known as Docket No. 2021-1211-
MWD.
2. The City is authorized to compensate the law firm of Lloyd Gosselink Rochelle &
Townsend, PC, in an amount not to exceed $600,000.00.
