BOWMAN CONSULTANT SUBJECT (ALL) Approve Fourth Amendment to City Secretary Contract No. 53147 with Dr. Theron L. Bowman for Consulting Work Associated with Review of Policing Practices to Increase the Total Amount of the Contract to $150,000.00 RECOMMENDATION: It is recommended that City Council approve the Fourth Amendment to City Secretary Contract No. 53147 with Dr. Theron L. Bowman for an aggregate total compensation not to exceed $150,000.00. DISCUSSION: The City Council approved a resolution on November 19, 2019 (Resolution No. 5148-11-2019) authorizing the City Manager to begin a Phase I review of the Fort Worth Police Department to identify patterns and practices related to police interactions with the public during investigative stops, searches, arrests, and use of force incidents. The resolution authorized the City Manager to enter into individual contracts with six national expert consultants with extensive police reform experience. In December 2019, the City Manager finalized the agreements, in an amount not to exceed $100,000.00, with each consulting group or individual. The panel of consultants are in the final stage of the Phase I review. The panel has examined police policies, operational practices, training, documentation, accountability systems, corrective and reporting procedures, and technology applications. The panel had substantial interaction and listening sessions with community members, groups, and police personnel to gain an understanding of the department overall and of the public's perception of the department. A preliminary report was delivered to the city in August and the final report will be completed before the end of the calendar year. To complete the Phase I review and final report, it is necessary to increase the total amount of the contract with Dr. Theron L. Bowman. Dr. Bowman is the chief scribe for the panel and is instrumental in completing the final report for Phase I. This contract has reached the current $100,000.00 limit before completion of the overall work, and any increase in contract spending limits to over $100,000.00 requires City Council approval. This contract has previously been amended to extend the term of the contract and to amend the scope of services. With approval of this M&C, the Fourth Amendment will change the compensation limit, which will be increased to a total of $150,000.00. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that upon approval of the recommendations, funds are available in the current operating budget, as appropriated, of the General Fund and that, prior to an expenditure being made, the City Manager's office has the responsibility to validate the availability of funds.
