HomeMy WebLinkAboutOrdinance 16971-05-2006Ordinance Na. 16971-05-2006 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE NEW EQUIPMENT PURCHASE FUND IN THE AMOUNT OF $843,837 TO BE OBTAINED THROUGH THE CITY'S EQUIPMENT NOTE PROGRAM APPROVED ON FEBRUARY 9, 1999, (M&C G-12462) BY ORDINANCE NO. 13701 FOR THE PURPOSE OF FUNDING TWO FIRE APPARATUS FROM THE HOUSTON GALVESTON AREA COUNCIL CONTRACTS WITH EMERGENCY VEHICLES OF TEXA5 AND METRO FIRE APPARATUS 5PECIALIST FOR THE FIRE DEPARTMENT; PROVIDING A SEVERABILITY CLAUSE MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES 1N CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE 1T ORDAINED ]3Y THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2005- 2006 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the New Equipment Purchase Fund in the amount of $843,837 to be obtained through the City's Equipment Note Program approved on February 9, 1999, (M&C G-12462} by Ordinance No. 13701 for the purpose of funding two fire apparatus from the Houston Galveston Area Council Contracts with Emergency Vehicles of Texas and ATC American LaFrance for the Fire Department. SECTION 2. That should any portion, section or part of a section of this severability clause be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in na way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 16582 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direc# conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. The purchase afi new fire apparatus from the Houston Galveston Area Council (HGAC} Contracts with Emergency Vehicles of Texas and ATC American LaFrance far the Fire Department far a cast not to exceed $843,837.00 with payment due within 30 days of the invoice date and freight is included in the unit price. DISCUSSIQN: This fire apparatus is being added to the City's fleet for assignment at the new Fire Station No. 41 located at Highway 287 and Bonds Ranch Road. The Equipment Notes program was established to provide financing for fire apparatus and other capital equipment purchases. Firefighters will use the apparatus to transport personnel and equipment to fires, hazardous incidents and other emergency situations in Station No. 41's district. The Fire Department has reviewed the pricing and finds the cost to be competitive. State law, provides that a local government purchasing an item under an interlacal cooperation contract satisfes any state law requiring that the Inca! government seek competitive bids for purchase of the item.
