AN ORDINANCE VACATING, ABANDONING AND
EXTINGUISHING ALL AN ALLEY AND PORTIONS OF TWO
ALLEYS LOCATED RESPECTIVELY IN THE J. MONTGOMERY
SURVEY, ABSTRACT NO. 1030, BLOCK 1, MATTISONS
ADDITION TO HI MOUNT, AN ADDITION TO THE CITY OF
FORT WORTH, TARRANT COUNTY, TEXAS, AS RECORDED IN
COUNTY CLERK'S VOLUME 310, PAGE 47, REAL PROPERTY
RECORDS, TARRANT COUNTY, TEXAS, AND RESPECTIVELY
CONTAINING APPROXIMATELY 3,598 SQUARE FEET OR
0.082; 3,000 SQUARE FEET OR .068 ACRE OF LAND AND 787
SQURE FEET OR 0.018 ACRES OF LAND; PROVIDING FOR
REVERSION OF FEE IN SAID LAND; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING
AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1.
1. That all of a fifteen foot wide public alley situated in the J. Montgomery
Survey, Abstract No. 1030, located in Block 1, Mattisons Addition to Hi
Mount, an addition to the City of Fort Worth, Tarrant County, Texas, as
recorded in Volume 310, Page 47, Plat Records, Tarrant County, Texas, and
containing approximately 3,598 square feet or 0.082 acres of land, and as
more specifically described in Exhibits "A", attached hereto and incorporated
herein by reference, be and the same is vacated, abandoned and extinguished.
2. That a portion of a fifteen foot wide alley situated in the J. Montgomery
Survey, Abstract No. 1030, located in Block 1, Mattisons Addition to Hi
Mount, an addition to the City of Fort Worth, Tarrant County, Texas, as
recorded in Volume 310, Page 47, Plat Records, Tarrant County, Texas, and
containing approximately 3,000 square feet or 0.068 acres of land, and as
more specifically described in Exhibits "B", attached hereto and incorporated herein

by reference, be and the same is vacated, abandoned and extinguished.
3. That a portion of a fifteen foot wide alley situation in the J. Montgomery
Survey, Abstract No. 1030, located in Block 1, Mattisons Addition to Hi
Mount, an addition to the City of Fort Worth, Tarrant County, Texas, as
recorded in Volume 310, Page 47, Plat Records, Tarrant County, Texas, and
containing approximately 787 square feet or 0.018 acres of land, and as more
specifically described in Exhibits "C", attached hereto and incorporated herein
by reference, be and the same is vacated, abandoned and extinguished.
SECTION 2.
That the easements to the land in the above-described vacated public alley rights
of way are hereby released and shall revert to the adjacent owner as provided by law.
SECTION 3.
That all existing utility easements shall be retained by the City until such time all
utilities located in that easement are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby
repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

RECOMMENDATION:
It is recommended that the City Council:
1.Adopt the attached ordinance vacating two alleys in Block 1, Mattison's Addition to Hi-Mount to be replatted with the adjoining property for a
mutltifamily development and a boutique hotel,Bowie House;and
2.Waive any and all purchase fee value of the vacated land in accordance with City policy.
DISCUSSION:
Dunaway Associates, on behalf of Bowie Place Properties, LLC, has requested vacation of these alleys to be replatted with the adjoining property
for a multifamily development and boutique hotel, Bowie House.The City Plan Commission recommended approval of this request at its meetings
on Augst 8,2020, September 9,2020 and November 11,2020.An acceptable final plat(FS-21-065)has been received in accordance with the
Subdivision Ordinance.
The City of Fort Worth(City)originally obtained the above mentioned right-of-way through plat dedication.The City does not own any fee interest in
the rights-of-way or own any property adjacent to the right-of-way and did not expend any City funds to purchase the right-of-way easement. In
accordance with the City's policy regarding street and alley vacation transactions approved by the City Council on March 6,2007, Mayor and
Council Communication(M&C G-15624),staff recommends waiving the fair market value or any portion thereof of purchase price of this right-of-
way easement for the alleys.
This project is located in COUNCIL DISTRICT 7.
A Form 1295 is not required because:This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION I CERTIFICATION:
The Director of Finance certifies that approval of these recommendations will have no material effect on City funds.
