HomeMy WebLinkAboutOrdinance 16972-05-2006ORDINANCE NO. 1.6972-05-2006 AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF DASHWOOD STREET FROM LIPSCOMB STREET, WEST TO TIIE MIDDLE OF BLOCK 5, FIELDS WELCH ADDITION, AN AIDITION TO THE CITY OF FORT WORTH, AND CONTAINING 8,600 SQUARE FEET, MORE OR LESS; PROVIDING FOR THE REVERSION OF FEE IN SAID LAND; THE RETAINMENT OF EXISTING UTILITY EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That a portioza of Dashwaod ,Street, twenty-six (26) feet in width bounded by Lot 4, Block 5 on the north, Lot 5, Black 5 on the south of Field Welch Addition, an addition to the City of Fort Worth, and Lipscomb Avenue on the east, and containing 2,600 square feet, more or less, and as more specifically described in Exhibits "1", " 2" and " 3" attached hereto and incorporated herein by reference, be and the same is vacated arzd extinguished. SECTION 2. That the fee to the land in the above-described street rights-af way is released and shall revert to the adjacent owner as provided. by law. SECTION 3. That all existing utility easements shall be retained by the City until such time all utilities located in that easement are relocated. at the owner's expense. SECTION 4, That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5. That this oxdinance shall take effect upon adoption. Containing Approximately 2,600 Square Feet or 0.06 Acres and Authorization of Waiver of the Purchase Fee and Application Fee for the Vacation of a Portion of Dashwood Street RECOMMENDATION: It is recommended that the City Council: 1. Adopt an ordinance vacating a portion of Dashwaad Street from Lipscomb Street west to the middle of Block 5, Fields Welch Addition, as recorded in Volume 33, Page 225, P.R.T.C.T. containing approximately 2,600 square feet or 0.06 acres; and 2. Authorize the waiver of purchase fee of $11,960.00 and the application fee for the vacation of a portion of Dashwood Street. DISCUSSION: J. B. Davies, fnc. has requested the above referenced vacation on behalf of, the Manu Group of Fort Worth, in order to replat it into the adjacent property. The Manu Group of Fort Worth also requests the waiver of the purchase fee for the land casts associated with the vacation. City staff recommends that the purchase fee of $11,960.00 and the application fee be waived in accordance with the Policy Regarding Valuation of Street Vacation Transactions in Central City Redevelopment Neighborhoods as passed by City Council an April 6, 1999, (M&C G-12532). Revievuing City departments and public utility companies have raised no objections to this request. The City Plan Commission recommended approval of this request at its meeting on March 22, 2006. The right-of-way being vacated is being retained as an easement for existing utilities. An acceptable replat, (FS-06-038}, has bean received. This vacation is located in COUNCIL ©fSTR1CT 9. FISCAL INFORMATiONICERTIFICATION: The Finance Director cerkifies that this action will have no material effect on City funds.
