Ordinance Na. 15974-D6-2DD6 AN ORDINANCE. INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIAL TRU5T FUND, MUNICIPAL COURT BUILDING SECURITY FUND IN THE AMOUNT OF $5D9,35D FROM AVAILABLE FUNDS FOR THE PURPOSE OF TRANSFERRING FUNDS TO THE GENERAL FUND FOR FISCAL YEAR 2DD4-D5 ANNUAL BUiLD1NG SECURITY COSTS, PROVIDING FOR A SEVERABiLI`lY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLfCT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2DD5- 2DD6 in the Budget of the City Manager, there shat! also be increased estimated receipts and appropriations in the Special Trust Fund, Municipal Court Building Security Fund in the amount of $509,35D from available funds for the purpose of transferring funds to the General Fund for Fiscal Year 2DD4-2DD5 Building Security Costs. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative ar void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, ar parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 15582 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriatinns are hereby expressly repealed. SECTION 4 This ordinance shall take effect upon adoption. '~~G-15224 SUBJECT: Adapt Appropriation Ordinance and Transfer of Funds from the Municipal Court Building Security Fund to the General Fund for FY2004-2005 Annual Building Security Costs -~ - - RECOMMEND,A,TION: It is recommended that the City Council: 1. Authorize the City Manager to transfer $509,350.00 from the Municipal Court Building Security Fund to the General Fund; and 2. Adapt the attached appropriation ordinance increasing estimated receipts and appropriations in the Special Trust Fund, Municipal Court Building Security Fund by $509,350.00 from available funds. ©tSCUSSION: This appropriation is required to reimburse the General Fund far actual building security expenses incurred during FY2004-2005. The Texas t.egislature, during the 1995 regular legislative session, adapted an amendment to Article 102.017 of the Cade of Criminal Procedure that allows the governing body of a municipality to create, by ordinance, a Municipal Court Building Security Fund. Defendants convicted in a trial far a misdemeanor offense in Municipal Court are required to pay a $3.00 security flee as a cast of the court. On October 10, 1995, Ordinance Na. 12204 was approved by City Council to create the Municipal Court Building Security Fund. Security fees collected may only be used for purposes of providing security services for buildings housing a municipal court. This may include the purchase of parcel X-ray machines, hand-held and walk through metal detectors, security personnel providing security services, and continuing education on security issues far court and security personnel. On June 20, 2000, (M&C G-12942) the City Cauncil authorized implementation of the Municipal Court Building Security Enhancemen# Plan. The plan authorized a Senior Deputy City Marshal and eight Deputy City Marshal positions dedicated to building security functions. The FY2004-2005 adopted budget for building security operations was $510,511.00. Actual salaries and departmental support expenses totaled $504,650.00 far the year, with additional court security expenses in the amount of $4,700.00 used to underwirte the cost of maintenance agreements for parcel X-ray machines. A total of $509,350.00 is required to reimburse the General Fund for annual FY2004-2005 building security expenses.
