Ordinance No. 1.6975-Ob-2006 AN ORDINANCE INGREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER CAPITAL PROJECTS FUND IN THE AMOUNT OF $228,662 FROM AVAILABLi= FUNDS FOR THE PURPOSE OF FUNDING A CONTRACT WITH VALLES UNDERGROUND UTILITIES, LTD., FOR WATER REPLACEMENT' CONTRACT 9gJJ AT VARIOUS LOCATIONS; PROVIDING FOR A SIrVERA8ILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR OR©INANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE lT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That 'sn addition to those amounts allocated to the various City departments far Fiscal Year 2t1Q5-2Ql)6 in the Budget of the Gity Manager, there shall also be increased estimated receipts and appropriations in the Water Capital Prnjeds Fund in the amount of $228,662, from available funds, for the purpose of funding a contract with Valley UnderxJround Utilities, Ltd. for Water Replacement Contract 99JJ at various locations. SECTION 2. That should any portion, section nr part of a section of this nrriinance be declared irnalir9, inoperative or void for any reason by a court of competent jurisdiction, Such decision, opinion ar judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full ford and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 16582 and ail other ordinances and appropriations amending the same except in those instances where the provisions of this nrrlinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize the transfer of $228,562.00 from the Water and Sewer Operating Fund to the Water Capital Projects Fund; 2. Adapt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $228,582.00; and 3. Authorize the City Manager to execute a contact with Valles Underground Utilities, Ltd. in the amount of $191,346.00 for Water Replacement on portions of South Grave Street, Atkins Street, Riley Street and Berke Road Contract, 99JJ. DISCUSSION: On September 30, 2003, (M&C C-19775) the City Cauncii authorized an engineering agreement with RJN Group, Inc., for the preparation of plans and specifications for Water Line Replacement Contract, 99JJ. The water lines to be replaced under this contract include: Street S. Grove Street Atkins Street Riley Street Berke Road From Biddisian Street Berke Road Berke Road Riley Street To Shaw Street McClure Street McClure Street Atkins Street After the proposed improvements are completed, all four streets will be pulverized and overlayed with asphalt under a separate contract. The project was advertised fnr bid on February 16 and 23, 2005 in the Commercial Recorder, on March 15, 2006, the following bids were received: Bidder Valles Underground Utilties, Ltd. S.H.U.C., inc. M.F. Burns Construction, Inc. Valley Underground Utilities, Ltd. is in compliance with the City's M/WBE Ordinance by committing to 44% MNVBE participation. The City's goal on this project is 15%. This project is located in COUNCIL DISTRICT 9, Mapsco 91 B and C.
