HomeMy WebLinkAboutOrdinance 16977-06-2006Ordinance No. 16977-06-2006 AN ORDINANCE INCREASING ESTIMATED RECE[PTS AND APPROPRIAT[ONS IN THE CRITICAL CAPITAL PROJECTS FUND IN THE AMOUNT OF $150,00() FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING THE HYDE PARK TRANSIT PLAZA PROJECT; PROVIDING FOR A SEVERABII_ITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE lT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 That in addition to those amounts allocated to the various City departments far Fiscal Year 2005- 2006 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Critical Capital Projects l=and in the amount of $150,000 from available funds, far the purpose of funding the Hyde Park Transit Plaza project. SECTION 2. That should any pnrtinn, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION ~. That this ordinance shall be cumulative of Ordinance No. 16582 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize the transfer of $150,DD0 from the General Fund to the Critical Capital Projects Fund; and 2. Adapt the attached appropriation ordinance increasing the estimated receipts and appropriation in the Critical Capital Projects Fund by $15D,000 from available funds for the Hyde Park Transit Plaza project. C1ISGUSSION: The proposed Hyde Park Transit Plaza at the intersection of Ninth and Throckmorton Streets is a collaborative effort by the City, the Fort Worth Transportation Authority (the T), the U.S. General Services Administration (GSA) and Downtown Fart Worth, [nc. The Hyde Park and Ninth Street Advisory Committee, chaired by Councilmember Wendy Davis, oversees the project. On October 13, 2D05, the North Central Texas Council of Governments' (NCTCOG) Regional Transportation Council approved an amendment to the Transportation Improvement Program (TIP) to shift $1.2 million in federal Surface Transportation Program for Metropolitan Mobility (STP-MM} funds from the Miller Road intersection improvement project to the Hyde Park Transit Plaza project. The STP-MM grant will fund the Hyde Park Transit Plaza intersection improvements at Ninth and Throckmortan Streets and certain property acquisition expenses. After a thorough analysis of the proposed Miller Road project, City staff concluded that the intersection improvements were not warranted. If the grant funds were not used for another City project, the funds would have reverted back to NCTCOG and may oat have been allocated back to the City. The Federal Transportation Administration administers the federal grant funds to be used for construction and the T is the grant recipient. The STP-MM grant requires a 2D percent, or $300,OOD, local match, which the City and the T have agreed to share equally as stipulated in the project interlocal agreement. The City's FY 2D05-2006 budget includes the City's $15D,000 share of the local match. The $15D,000 loco! match must now be appropriated and moved from the General Fund to the Hyde Park Transit Plaza account. On October 4, 2005, (M&C C-21068) the City Council approved an amendment to the interlocal agreement with the T to reflect the revised project budget in anticipation of the TIP amendment. Nyde Park was originally conceptualized during the 1999 study of the Intermodal Transportation Center. The study recommended dispersing bus transfer activity throughout Downtown and identified Hyde Park at the intersection of Ninth and Throckmortan Streets as the most promising location for a transit plaza. Since 1999, the City, the T, GSA and Downtown Fort Worth, loc., have worked together to secure funding and to design the proposed transit plaza. In May, the T purchased the parking lot at the northeast corner of Throckmorton and Ninth Streets that is integral to the transit plaza design. Construction an the Hyde Park Transit Plaza is scheduled to begin in November 2006. This project is located in COUNCIL DISTRICT 9. FISCAL INFORMATIONICERTIFICATION: The Finance Director certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of the Capital Projects Fund.
