HomeMy WebLinkAboutOrdinance 16978-06-2006Ordinance No. 1£978-06-2006 AN ORDINANCE INCREASING APPROPRIATIONS IN THE CULTURE AND TOURISM FUND IN THE AMOUNT OF $455,146 AND bECREASING THE UNRESERVED, UNDESIGNATED 1=UND BALANCE BY THE SAME AMOUNT, FOR THE PURPOSE OF TRANSI=ERRING SAID FUNDS TO THE SPECIALLY FUNDED CAPITAL PROJECTS FUND TO EXECUTE A CONTRCT WITH TRI- TECH CONSTRUCITON, INC. FOR STORM DRAIN IMPROVEMENTS ON 143" STREET, THROCKMDRTON STRI=ET, AND HOUSTON STREET; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HIvR1=WITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to thaw amounts allocated to the various City departments for Fiscal Year 2005- 2006 in the Budget of the City Manager, there shall also be increased appropriations in the Culture and Tourism Fund in the amount of $455,1€6 and decreasing the unreserved, undesignated fund balance by the same amount, for the purpose of transferring said funds to the Specially Funded Ca~ital Projects Fund to execute a contract with Tri-Tech, Inc. for Storm Drain Improvements on 14t Street, Throckmorton Street, and Haustan Street. SIWCTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 16582 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 ADOPTED AND EFFECTIVE: June 13 2006 This ordinance shall take effect upon adoption. C~ ®f F® ~h, 7°ex~s r ~I REC~MMEiV;I~ATiON: It is recommended that the City Council: 1. Adopt the attached appropriation ordinance increasing appropriations in the Culture and Tourism Fund by $455,145.00 ,and decreasing the unreserved, undesignated fund balance by the same amount; 2. Authorize the transfer of $455,146.00 from the Culture and Tourism Fund to the Specially Funded Capital Projects Fund; 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Specially l=unded Capitai Projects Fund in the amount of $455,946.00, from available funds; and 4. Authorize the City Manager to execute a contract with Tri-Tech Construction, inc. in the amount of $395,425.00 for Storm Drain improvements an 14th Street, Thrackmorkon Street and Houston Street. ©ISCUSSiON: On January 24, 2006, {M&C C-29263) the City Counci! authorized the City Manager to execute an engineering agreement with t_opezGarcia Group, to prepare plans and specifications for storm drain, paving and traffic signal improvements on 12th Street, 13th Street, 14th Street, Throckmorton Street and Houston Street. in order to expedite and to closely coordinate the relocation of all existing public and private underground utilities located on the identified streets, the project was divided into two portions {storm drain and paving and traffic signal improvements) for construction purposes. Council approval is being sought for construction of the storm drain improvements via this M&C and the paving and traffic signal improvements will iae advertised for bid at a future date. This project consists of the installation of a storm drain system an the fallowing streets and wiii facilitate the construction of the Omni Hotel and the City parking garage, both of which are proposed west of the Fort Worth Convention Center: StFB~t 14th Street Throckmorton Street From Ta Throckrnorton Street Houston Street 13th Street 14th Street Logname: 303014TH Page 1 of 3 Houston Street 13th Street 14th Street After the proposed improvements are completed, all disturbed segments of paving will be permanently repaired with asphalt. The project was advertised for bid on May 4 and 11, 2006. In addition, $19,771.00 is provided for project contingencies. MIWEiE -Tri-Tech Construction, Inc. is in compliance with the City's MIWBE Ordinance by comrr~itting to 19% MNVBE participation. The City's goal on this project is 1 S%. The project is located in COUNCIL DISTRICT 9, Mapscn 77A. FISCAL 1NFORMATIONlCERTIFICAT60N: The Finance Director cerkifiies that upon approval of the above recommendations and adoption of the attached appropriation ordinances, funds will be available in the current capital budget, as appropriated, of the Specially Funded Capital Projects Fund. The unreserved, designated fund balance of the Culture and Tourism Fund will be $12,198927.00 after this appropriation.
