On February 19, 201,31 (M&C C-26119 the City Council authorized acceptance of a State Regional
Toll Revenue Grant in the amount of 3„363,577 00 via a Funding Agreement with the Texas
Department of Transportation with a transfer in the amount of$840,894.00 from the Street
Improvements,ents 2008 Fund to the Grant Capital Projects Fund to he applied towards the fit is snatch
to be used for the construction of a undivided four-Mande bridge over Fossil Creek.
The ;purpose of this Mayor and Council Communication is to authorize the execution of a construction
contract Frith AUI Contractors, LLC, in the amount of$3,54,8,929.87 for construction) of a four-lane
undivided bridge across Fossil Creel. This project also includes sidewalks and streetlights..

19 3.1 Time is of the essence.
All time limits for Milestones, if any, and Final Acceptance as stated in the Contract
1 Documents are of tile essence to this Contract.

3 The Work will be complete for Final Acceptance within 2,10 days after the date when the
4 Contract Time commences to run as provided in paragraph 2.03 of the General Conditions.
25 3.3 Liquidated damages
6 Contractor recognizes that time is of the essence of this Agreement and that City will
27 suffer financial loss if the Work is not completed within the times specified in Paragraph
28 3.2 above, plus any extension thereof allowed in accordance with Article 12 of the
29 General Conditions. The Contractor also recognizes the delays, expense and difficulties
30 involved in proving; in a legal proceeding the actual less suffered by the City if the Work
is not completed on tine. Accordingly, instead of requiring any such proof, Contractor

hat as liquidated damages for delay abut not as a penalty , contractor shall pad
