HomeMy WebLinkAboutOrdinance 16983-06-2006Ordinance Na. 16983-06-2006 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS 1N THE ENVIRONMENTAL MANAGEMENT PROJECT FUND IN THE AMOUNT OF $36,324.25 FROM A TRANSFER FROM THE ENVIRONMENTAL MANAGEMENT OPERATING FUND, FOR THE PURPOSE OF FUNDING A CONTRACT WITH PONCE CONTRACTORS, WC., FOR ASBESTOS ABATEMENT SERVICES AT HARi_EY SERVICE CENTER STRUCTURES; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES iN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2005- 2006 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Environmental Management Project Fund in the amount of $36,324.25 from a transfer from the Environmental Management Operating Fund far the purpose of funding a contract with Ponce Contractors, Inc. for asbestos abatement services at Harley Service Center structures. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 16582 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect upon adoption. Authorize the City Manager to execute a contract with Ponce Contractors, inc., far asbestos abatement services of Harley Service Center structures in the amount of $36,324.25; 2. Approve the transfer of $36,324.25 in undesignated funds in the Environmental Management Operating Fund to the Environmental Management Project Fund; and 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Environmental Management Project Fund by $36,324.25. DISCUSSION: The Harley Street compound has eight structures with asbestos containing materials (ACM) which require abatement prior to demolition. The ©epartment of Environmental Management is contracting for removal of the ACM in these structures. A Request for Bid was advertised on April 13, 2006. Bids for the asbestos abatement were submitted by seven licensed contractors on May 18, 2006. Ponce Contractors, Inc., is in compliance with the City's MIWBE Ordinance by committing to 10% MNVBE participation. The City`s goal on this project is 10%.
