HomeMy WebLinkAbout(0061) M&C 21-0911City of Fort Worth, Texas Mayor and Council Communication DATE: 11/30/21 M&C FILE NUMBER: M&C 21-0911 LOG NAME: 23TERRACON BROWNFIELDS CONTRACT AMENDMENT 3 SUBJECT (ALL) Authorize Execution of Amendment No. 3 to City Secretary Contract No. 52535 with Terracon Consultants, Inc., in the Amount of $105,000.00 for Providing Continued Engineering Professional Services for the City of Fort Worth Environmental Protection Agency Brownfields Program, Thereby Revising the Total Contract Amount to $205,000.00 RECOMMENDATION: It is recommended that the City Council authorize execution of Amendment No. 3 to City Secretary Contract No. 52535 with Terracon Consultants, Inc., in the amount of $105,000.00 for providing continued engineering professional services for the City of Fort Worth Environmental Protection Agency Brownfields program, thereby revising the total contract amount to $205,000.00 (City Project No. 103209). DISCUSSION: The purpose of the Mayor and Council Communication (M&C) is to authorize Amendment No. 3 to City Secretary Contract (CSC) No. 52535 for professional engineering services with Terracon Consultants, Inc., for the continued support of the City of Fort Worth's Environmental Protection Agency (EPA) Brownfields program. Terracon Consultants, Inc. will continue to provide for programmatic support of the Brownfields program with periodic reporting to the EPA Region 6 coordinator, continued Phase I Environmental Site Assessment (ESA) investigations, continued Phase II ESA -Limited Subsurface Investigations, and continued development and enchancement services for program advancement. M&C 20-0182 dated March 17, 2020 authorized the City of Fort Worth (City) to apply for an EPA Brownfields Grant in the amount up to $300,000.00 for conducting environmental site assessments and developing cleanup plans for the neighborhoods included in the boundaries of Interstate 30 (1-30), Interstate 35W (1-35W), West Seminary Drive, and 8th Avenue/Granbury Road in Fort Worth. The City of Fort Worth was awarded a $300,000.00 Targeted Brownfields Grant from the EPA in October 2020. Since the receipt of the grant, the City has conducted eleven (11) Phase I Environmental Site Assessments and one (1) Phase II ESA - Limited Subsurface Investigation. Currently the City has three (3) Phase I ESAs in queue, and two (2) Phase II ESA - Limited Sub -Surface Investigations in queue. These Environmental Site Assessments have involved parkland dedication, developer sponsored multi -family residential development, single and multiple family residential development, open space acquistions, public safety development, and neighborhood enhancement projects within the City of Fort Worth. The EPA Assessment Grant provides funds under the Small Business Liability Relief and Brownfield Revitalization Act and under §104(k)(2) of the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA). This grant allows the City to conduct environmental site assessments, the results of which can be used to create cleanup plans and to facilitate remediation and subsequent reuse. These grant -funded activities will be directed at sites with either hazardous substance or petroleum contamination located in the neighborhoods included in the boundaries of 1-30, 1-35 W, West Seminary Drive, and 8th Avenue/Granbury Road in Fort Worth. With environmental site assessments completed, the City can anticipate successful future applications for other EPA grant programs which fund environmental cleanup activities. Based on potential brownfield sites inventoried in 2019-20, approximately 400 potential brownfield sites are located within the City and additional sites can still be identified. M/WBE Office - Terracon Consultants, Inc. agrees to maintain its initial M/WBE commitment of 15% that it made on the original and extend and maintain that same M/WBE commitment of 15% to all priors up to and inclusive of this Amendment to CSC No. 52535. Therefore Terracon Consultants, Inc. remains in compliance with the City's M/WBE Ordinance and attests to its commitment by its signature on the Acceptance of Previous M/WBE Commitment form executed by an authorized representative of its company. The project will serve Fort Worth residents in ALL COUNCIL DISTRICTS. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that funds will be available in the current operating budget, as previously appropriated, in the Grants Operating Federal Fund to support the above recommendation and execution of the amendment to the contract.
