HomeMy WebLinkAboutOrdinance 19398-10-2010 Ordinance No. 19398-10-2010 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $384,960.00 SUBJECT TO RECEIPT OF THE FISCAL YEAR 2010 SOLVING COLD CASES WITH DNA GRANT FROM THE UNITED STATES DEPARTMENT OF JUSTICE, NATIONAL INSTITUTE OF JUSTICE, FOR THE PURPOSE OF FUNDING THE IDENTIFICATION, REVIEW AND INVESTIGATION OF VIOLENT CRIME COLD CASES; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2010-2011 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of$384,960.00, subject to receipt of the FY 2010 Solving Cold Cases with DNA Grant from the U.S. Department of Justice, National Institute of Justice, for the purpose of funding identification review, and investigation of violent crime cold cases. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No.19355 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Ratify the application for the Fiscal Year 2010 Solving Cold Cases with DNA Grant from the U.S. Department of Justice, National Institute of Justice in the amount of$384,960.00; 2. Authorize the City Manager to accept the grant funds, if awarded, by executing a contract with the U.S. Department of Justice, National Institute of Justice for that purpose; and 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund by $384,960.00 upon receipt of the grant. DISCUSSION: Currently the City of Fort Worth has nearly 770 open cold cases dating back to 1966 that have the potential to be solved using DNA analysis. Although physical evidence was preserved and retained, the majority of unsolved homicides that occurred between 1966 and 1990 were not analyzed for the presence of biological evidence. However, by applying the advanced scientific methods within the field of DNA analysis, these cases may have the potential to produce a DNA profile and a potential suspect. Grant funds from the U.S. Department of Justice, National Institute of Justice Fiscal Year 2010 Solving Cold Cases with DNA Grant will be used to identify, review, and investigate violent crime cold cases that have the potential to be solved through DNA analysis and to locate and analyze biological evidence associated with these cases. Funding will provide for the salary and fringe benefits for a Cold Case Detective for an 18-month period, salary and fringe benefits for an Evidence Technician for the Crime Lab for a 12-month period, investigative travel and DNA outsourcing. Of the total amount requested, $186,580.00 has been budgeted for the salary and fringe benefits for the two positions, $4,230.00 has been budgeted for investigative travel, and $194,150.00 has been budgeted for the DNA outsourcing costs.
