HomeMy WebLinkAboutOrdinance 19413-10-2010 Ordinance No. 19413-10-2010 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $150,000.00, SUBJECT TO RECEIPT OF A GRANT FROM THE TEXAS DEPARTMENT OF AGRICULTURE FOR THE CHILD AND ADULT CARE NUTRITION PROGRAM FOR AT-RISK AFTER SCHOOL PROGRAMS; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2010-2011 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $150,000.00, subject to receipt of a grant from the Texas Department of Agriculture for the Child and Adult Care Nutrition Program for At-Risk After School Programs. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No.19355 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize the City Manager to apply for and accept, if awarded, a grant from the Texas Department of Agriculture in an amount up to $150,000.00 for the Child and Adult Care Nutrition Program for At-Risk After School Programs; 2. Authorize the execution of a contract with Texas Department of Agriculture for the Child and Adult Care Nutrition Program, At-Risk After School Programs for the Fiscal Year October 1, 2010, through September 30, 2011, upon receipt of the grant; 3. Authorize the City Manager to waive the indirect costs, which are not allowed by this grant and are addressed by other grants that provide salaries for staff; and 4. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund by up to $150,000.00, subject to receipt of the grant. DISCUSSION: The Child Nutrition Reauthorization Act provides reimbursement for snacks served to children through age eighteen who are participating in certain after school programs. The programs must be located in low- income areas and should be designed to provide the types of activities known to reduce or prevent involvement in juvenile crime. The basic purpose of the program is to provide care for children after the school day has ended, and the program must provide children with regularly scheduled educational or enrichment activities in a structured and supervised environment. The Texas Department of Agriculture has notified the City that funds are available for the Child and Adult Care Nutrition Program for At-Risk After School Programs. It is projected that 100,000 snacks will be served to approximately 1,000 children at nineteen community centers operating At-Risk After School Programs from October 1, 2010, through September 30, 2011. The Community Services Division of the Parks and Community Services Department will administer the program according to guidelines established by the U.S. Department of Agriculture and the Texas Department of Agriculture. Existing staff administers this program, and the grant does not allow for the inclusion of indirect costs. This program serves ALL COUNCIL DISTRICTS.
