WHEREAS, The City of Fort Worth ("City") and Perkins+Will, Inc. ("Architect") made
and entered into City Secretary Contract No. 47468 (the Contract) which was
authorized by the City Council by M&C C-27600, the 12th day of January, 2016, for the
design of the Far North Library; and Amendments No. 1 , 2, 3, 4 & 5 were
administratively executed in the amount of $88,155.00 to include the designated
Amendment No. 1's Attachment "A", to complete easement vacation exhibits & create
access easement exhibits, to reimburse the Architect for Additional expenses, and to
complete a Terrestrial Lidar Scanning & Elevation verification survey of existing
concrete slab foundation, & to compensate the Architect for additional Construction
Administration Services for the increase of duration in the construction schedule; and
WHEREAS, further amendment is necessary to reimburse the Architect for additional
construction administration services for the unprecedent period to complete
construction of the new Far North Library facility including modification of the circulation
desk design.
NOW THEREFORE, City and Architect, acting herein by and through their duly
authorized representatives, enter into the following agreement which amends the
Contract:

Article I, (6) — Scope of Services, a paragraph shall be added to read as follows:
Provide additional services for the construction administration phase of the
Project. The additional expense allocation is $29,000.00. The scope of services
is described more fully in Perkin+Will's letter, Attachment "F" dated September 7,
2021 , subject: Re: ASR-05 Fort Worth Far North Branch Library: Construction
Duration Increase and Interior Redesign work".

Article II, (1 ) — Compensation, first paragraph, is amended as follows:
"Consultant shall be compensated in accordance with the Fee Schedule shown
in Attachment "F". Payment shall be considered full compensation for all labor,
materials, supplies, and equipment necessary to complete the services
described in Attachment "F". However, the total fee paid by the City shall not
exceed a total of $772,055.00 which includes $20,000.00 in reimbursable
expenses unless the City and the Consultant mutually agree upon a fee amount
for additional services and amend this Agreement accordingly."

All other provisions of this Contract which are not expressly amended herein shall
remain in full force and effect.

RECOMMENDATION:
It is recommended that the City Council authorize the execution of Amendment No. 6 to the Architectural Services Agreement with Perkins&Will,
Inc., in the amount of$29,000.00, for a total contract value of$772,055.00, to provide additional design and construction administration services
for the Golden Triangle Library.
DISCUSSION:
The purpose of this Mayor&City Council Communications(M&C)is to recommend that the City Council authorize the execution of Amendment
No. 6 to the Architectural Services Agreement with Perkins&Will, Inc., in the amount of$29,000.00, for a total contract value of$772,055.00,to
provide additional design and construction administration services for the Golden Triangle Library.
This library project was part of the 2014 Bond Program and design started in 2016(M&C C-27600). The project was awarded for construction in
May of 2017. Once the project was well into construction,the contractor encountered several issues and the project slowed down and the opening
was delayed several times. City staff made numerous attempts to work with and complete the project, however this construction contract was
terminated and the balance of the work was completed by a different contractor. The Golden Triangle Branch Library opened in the summer of
2020.
This change of contractors and long delay required the design architect, Perkins&Will, Inc.,to provide additional design and construction
administration services. The closeout for this project budget has been further delayed while the City works and resolves claims with the terminated
contractor's bonding company. It is clear that at this time there are no more services required of Perkins&Will, Inc. and there are sufficient
remaining project funds to close this contract.

The Golden Triangle Library is located in COUNCIL DISTRICT 7.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that funds are available in the current capital budget, as appropriated, in the 2014 Bond Program Fund for the
Golden Triangle Branch Library Project to support the approval of the above recommendation and execution of the amendment. Prior to any
expenditure being incurred, Property Management Department has the responsibility to validate the availability of funds.

Dear Alfonso,
Per the City of Fort Worth's request, this is an additional services proposal for the City of Fort
Worth Far North Branch Library.
In accordance with our City of Forth Worth Contract No. 47468, Article I, Scope of Service (2),
(3), and (4), this additional fee is required to provide services in excess of the original contract
duration of twelve (12) months, as described in Contract Attachment A, page 2.
The fixed fee for Construction Contract Administration Services for this additional duration is
Twenty-Four Thousand Dollars ($24,000.00).
Further, Perkins+Will acknowledges that we have been directed by the Fort Worth Public Library
to redesign the Holds area, which will require staff time to create details, redraw the permit
drawings, and coordinate its construction. Our proposed fee for this rework will be Five
Thousand Dollars ($5,000.00).
To summarize, the Grand Total of fees plus reimbursable expenses for this Additional Services
Request is Twenty-Nine Thousand Dollars ($29,000.00).
Please provide written consent for these additional services, if you agree, and we will adjust our
work plan accordingly.
