FIRST AMENDMENT TO CITY SECRETARY CONTRACT NUMBER 56775
A COMMUNITY FACILITIES AGREEMENT
BETWEEN THE CITY OF FORT WORTH AND TA DFW BERRY LP
This FIRST AMENDMENT TO CITY SECRETARY CONTRACT NUMBER
56775 ("First Amendment") is made and entered into by and between the City of Fort Worth
("City"), a home-rule municipal corporation of the state of Texas, and TA DFW Berry LP
("Developer"), a Delaware limited partnership.
WHEREAS, the City and Developer entered into a Community Facilities Agreement
for the construction of public infrastructure improvements for a Project known as Rocketship
Berry, City Secretary Contract Number 56775 ("CFA"); and
WHEREAS, after execution of the CFA, but before proceeding to construction,
Developer's contractor submitted a revised bid with increased construction costs and an
increase in the number of estimated working days; and
WHEREAS, the City and Developer desire to amend the CFA to reflect that revised
bid and costs; and
WHEREAS, Developer has submitted a bond rider to the City to increase the amount
of the financial guarantee and has paid additional estimated construction services inspection
fees;
NOW THEREFORE, City and Developer, acting herein by and through their duly
authorized representatives, enter into the following agreement which amends City Secretary
Contract No. 56775:
1.
Section 36 of the CFA,the Cost Summary Sheet, is amended to be and read as set forth
in Exhibit"A" of this First Amendment.
2.
The Cost Estimate attachment to the CFA is amended to be and read as set forth in
Exhibit"B" of this First Amendment.
3.
a. All other provisions of City Secretary Contract Number 56775 which are not expressly
amended herein, shall remain in full force and effect.
b. All terms in this First Amendment that are capitalized, but not defined, shall have the
meanings ascribed to those terms in City Secretary Contract Number 56775.
