AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS
IN THE MUNICIPAL COURT BUILDING SECURITY PROJECT SECTION OF THE
SPECIAL TRUST FUND IN THE AMOUNT OF $322,512.00, FROM AVAILABLE FUNDS,
FOR THE PURPOSE OF REIMBURSING THE GENERAL FUND FOR FISCAL YEAR
2009-2010 BUILDING SECURITY COSTS; PROVIDING FOR A SEVERABILITY CLAUSE;
MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH;AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2010-2011 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the
Municipal Court Building Security Project section of the Special Trust Fund in the amount of $322,512.00,
from available funds, for the purpose of reimbursing the General Fund for Fiscal Year 2009-2010 building
security costs.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No.19355 and all other ordinances and appropriations
amending the same except in those instances where the provisions of this ordinance are in direct conflict
with such other ordinances and appropriations, in which instance said conflicting provisions of said prior
ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Adopt Appropriation Ordinance and Authorize Transfer of Funds from the Special Trust Fund, Municipal
Court Building Security Project in the Amount of$322,512.00 to Reimburse the General Fund for Fiscal
Year 2009-2010 Building Security Cost
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations in the
Special Trust Fund, Municipal Court Building Security Project by $322,512.00 from available funds; and
2. Authorize the City Manager to transfer$322,512.00 from the Special Trust Fund, Municipal Court
Building Security Project to the General Fund.
DISCUSSION:
On June 20, 2000, (M&C G-12942) the City Council authorized implementation of the Municipal Court
Building Security Enhancement Plan. It authorized the use of Municipal Court Building Security Project
funds for staffing dedicated to building security functions. The staffing level was established at one Senior
Deputy City Marshal and eight Deputy City Marshals. The transfer of$322,512.00 from the Special Trust
Fund, Municipal Court Building Security Project reimburses the General Fund for Fiscal Year 2009-2010
building security expenses related to these nine positions.
This appropriation reimburses the General Fund for expenses associated with salary and departmental
support requirements for one Senior Deputy City Marshal and eight Deputy City Marshal positions
dedicated to building security functions during Fiscal Year 2009-2010.
The Texas Legislature, during the 1995 regular legislative session, adopted an amendment to Article
102.017 of the Code of Criminal Procedure to allow the governing body of a municipality to create, by
ordinance, a Municipal Court Building Security Fund. Defendants convicted of a misdemeanor offense in
municipal court are required to pay a $3.00 security fee as a cost of the court. On October 10, 1995,
Ordinance No. 12204 was approved by City Council to create the Municipal Court Building Security Fund.
Security fees collected may only be used for purposes of providing or enhancing security services for
buildings housing a municipal court. Acceptable uses include the purchase of equipment(such as parcel
x-ray machines and hand-held and walk-through metal detectors), paying staff costs for personnel
providing security services, and providing continuing education on security issues for court and security
personnel.
