HomeMy WebLinkAboutContract 49559-A6 AMENDMENT NO. 6 TO AGREEMENT STANDARD AGREEMENT FOR PROFESSIONAL SERVICES OLD HEMPHILL ROAD DROP-OFF STATION ADDITION STATE OF TEXAS 49559-A6 CITY SECRETARY CONTRACT NO. COUNTY OF TARRANT WHEREAS, The City of Fort Worth and Elements of Architecture, Inc., (Consultant) made and entered into City Secretary Contract No. 49559 (The Contract) which was authorized by the City Council by M&C Reference No.: C-28324, the 15th day of August, 2017, for Old Hemphill Road Drop-Off Station Addition; and Amendments No. 1, No. 2, No. 3, No. 4, & No. 5 were administratively executed in the amount of $74,041 .00 for revisions to the PD site plan; and for additional signage design services, security modifications to existing site surveillance, and additional construction administration services due to changes in the construction sequence; and design services agreement for additional site lighting and provision for additional security cameras including photometric study to confirm light coverage to enhance security; retaining wall foundation & Urban Forestry modifications; and additional structural revisions to the existing retaining wall, respectively; and WHEREAS, further amendment is necessary to reimburse the Consultant as part of the design services agreement for the extended duration of construction schedule due to delays experienced by the general contractor. NOW THEREFORE, City and Consultant, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1 . Article I — Scope of Services, Paragraph (2) shall be added to read as follows: (2) Provide additional design, Architectural & Engineering, for the Drop-Off Station. The cost of this additional service is $9,980.00 without additional reimbursable expenses. The scope of services is described more fully in Elements of Architecture, Inc. Letter dated December 3, 2021 , subject: "Proposal for Hemphill Drop-Off Center — Additional Services, Additional CA Phase Services & Electrical. 2. Article II — Compensation, first paragraph, is amended as follows: "Consultant shall be compensated in accordance with the Fee Schedule shown in Attachment "G". Payment shall be considered full compensation for all labor, materials, supplies, and equipment necessary to complete the services described in Attachment "G". However, the total fee paid by the City shall not exceed a total of $182,837.00 including $6,900.00 in reimbursable expenses unless the City and the Consultant mutually agree upon a fee amount for additional services and amend this Agreement accordingly." Fort Worth,Texas76104 Phone 817.333.2880 Fax 817.333.2883 REVISED December 3, 2021 Alfonso Meza City of Fort Worth 401 West 13th Street Fort Worth, TX 76102 Re: Proposal for Hemphill Drop Off Center—Additional Services Additional CA Phase Services and Electrical Dear Alfonso; Elements is pleased to provide to you this proposal for services associated with completion of the project for services in excess of those previously defined. With the unexpected duration to complete the two previous drop- off centers and currently experiencing construction delays with the Old Hemphill Drop-Off, we anticipate an additional effort of construction administration time on our behalf to complete this project through closeout. This proposal also includes the electrical changes and additional power as was requested and as illustrated in Revision 12 to the construction documents.This does not include any effort associated with providing the separate project for the scrap metal yard work.Those services will be provided in a separate proposal. We do anticipate continuation of the OAC meetings, review of conditions and general coordination and closeout to complete this project within the following hours proposed.This proposal is in addition to the fee still left in our previous phases of work. TOTAL PROPOSED FEE Labor We propose to provide our services as identified in this proposal for the hourly not to exceed fee as follows: Architectural Services (50 hours x $182) $ 9,100 Electrical Engineering (800 x 1.1) 880 TOTAL ADDITIONAL SERVICES $ 9,980 Fees listed above are for labor only. We have not included any expenses as we believe we can cover any within our existing remaining expense balance. PROJECT TEAM The design team remains the same with all firms being SBE certified. If this proposal meets with your approval, we would anticipate an amendment to our contract for services identified within this proposal.
