HomeMy WebLinkAboutOrdinance 16992-06-2006Ordinance No. 16992-D6-2DD6 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATION5 IN THE ENVIRONMENTAL MANAGEMENT PROJECT FUND IN THE AMOUNT OF $188,781 FROM A TRANSFER FROM THE ENVIRONMENTAL MANAGEMENT OPERATING FUND, FOR THE PURPOSE OF FUNDING A CONTRACT WITH INTERCOM ENVIRONMENTAL, INC. TO REMOVE UNDERGROUND AND ABOVEGROUND STORAGE TANKS AT HARLEY SERVICE CENTER; MAKING THIS ORDINANCI= CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2DD5- 2DD6 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Environmental Management Fund in the amount of $188,781 from a transfer from the Environmental Management Operating Fund, for the purpose of funding a contract with lntereon Environmental, Inc. to remove underground and aboveground storage tanks at Harley Service Center_ SECTION 2. That should any portion, section ar part of a section of this ordinance be declared invalid, inoperative nr void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shah be and remain in full force and effec#. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 16582 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take efFect upon adoption. Authorize the City Manager to execute a contract with Intercon Environmental, lnc. to remove underground and aboveground storage tanks at Harley Service Center with snot-to-exceed amount of $188,781.D0; 2. Approve the transfier of $188,781.00 in undesignated funds in the Environmental Management Operating Fund to the Enviranmental Management Project Fund; and 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Environmental Management Project Fund by $188,781.D0. ©ISCUSS[ON: The Harley Street compound has four underground storage tanks and three aboveground storage tanks to be removed. The three aboveground storage tanks contain asphalt emulsion requiring disposal. The Department ofi Environmental Management is contracting for removal of these underground and aboveground storage tanks and disposal of the asphalt emulsion. A Request far Bid (DEM Dfi-02: HSC) was adverkised on April 13, 20Dfi. Although most expensive, Intercon's bid is within the estimated level of effort required for subcontracted removal and disposal services. The contract is based upon the time and materials utilized to remove this material. Staff will work closely with contractors to ensure that all efficiencies are realized Staff recommends award of the contract to Intercon Environmental, Inc. Intercon Environmental, Inc. is in compliance with the City's M/WBE Ordinance by committing to 41 % MNVBE participation. The City's Baal on this portion of the project is 15%.
