HomeMy WebLinkAboutOrdinance 17000-06-2006Ordinance Na. 17000-OB-2008 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $3,000,000 FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING THE MUSEUM PLACE DEVELOPMENT SUSTAINABLE DEVELOPMENT PROJECT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2005- 2008 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $3,000,000, from available funds, far the purpose of funding the Museum Place Development Sustainable Development Project. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative ar void far any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SI=CTION 3. That this ordinance shall be cumulative of Ordinance No. 16582 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Adopt the attached resalutinn to authorize entering into an interlocal agreement (ILA) with the North Central Texas Council of Governments {NCTCOG) for the Museum Place Develnpment Sustainable Development project {Project); 2. Authorize the City Manager to accept Sustainable Development funds in the amnunt of $2,400,000 from NCTCOG; 3. Authorize acceptance of funds from Cultural District Development Initiatives, Inc. in the amount. of $600,000 for the local match; 4. Authorize execution of an Enhanced Community Facilities Agreement with Cultural District Develnpment Initiatives, Ine.; 5. Adapt the attached appropriation ordinance increasing the estimated receipts and appropriations in the Grants Fund by $3,000,000; and 6. Authorize payment of $600,000 to NCTCOG in lieu of administrative fees, with the understanding that these funds will be reimbursed in full upon Project completion. ©ISCl1SSIOM; On January 19, 2006, {M&C G-15065} the City Council authorized the Planning Department to submit nominations fnr seven projects fnr funding through the Sustainable Development Program. On April 13, the Regional Transpnrtatinn Council approved funding in the amnunt of $2,400,000 million fnr the Museum Place Development Project. This grant amount requires a loco! match of $600,000, which brings the total Project amount to $3 million. Cultural District Development Initiatives, loc. has Gammltted to provide $600,000 far this local match requirement. Logname: 22SDMUSEUMt'LACE Page 1 of 2 In lieu of charging administrative fees, NCTCOG requires that the local match be paid before they will issue a Notice to Proceed on the Project. NCTCOG will return these funds to the City when expenditures have reached 80% of the Project fatal, and retain the interest earned to cover administrative casts. Upon approval of this M&C, staff will complete the fnllnwing activities: Submit resolution to NCTCOG on or before Friday, July 14, for consideration by the Surface Transportation Technics! Committee, the Regional Transportation Council, and the Executive Board of NCTCOG. • Upon approval by the aforementioned bodies, work with NCTCOG to execute an interlocal agreement. • Submit payment of $600,004 to NCTCOG, which will be reimbursed in entirety upon completion of the Project. • After receipt of a Notice to Proceed, issue a request for qualifications from appropriate engineering firms.
